Chargeback on a software purchase possible?

I want to do a chargeback on some software that i bought. Thing was that it was not working and full of bugs. The processor was 2checkout. their terms and service said no refunds, but i figure they didnt deliver me a working product.

thoughts?

You mean the maker of the software said no refunds possible?

sickbeatz 12-30-2005 09:16 AM

did you read the t.o.s.

TheDoc 12-30-2005 09:18 AM

Call the processor, tell them you are going to chargeback, chances are they will refund you. If not, call your bank, say you didn't make those charges.

Pretty much how most member chargebacks work.

i did ask and they are slow to support

its a big software. I expect bugs, fine, but to not even be functional on my domain. Was not something i bargained for.

im sure i can still win it from my visa if not 2checkout, they deliver un-usable software.. i wonder what they would do tho..

Pornwolf 01-04-2006 12:12 AM

Hell, you can chargeback a used condom if you want. Chargebacks are pretty much unlimited now a days.

LiveDose 01-04-2006 12:13 AM

Of course you can. If something is buggy and doesn't work why do you think you would have to pay for it? Try contacting them first...

The Truth Hurts 01-04-2006 12:15 AM

so what software was it?

sandman! 01-04-2006 12:21 AM

if you used amx its simple anything amx thats not shipped example would be software is a simple chargeback nothing 2checkout can do about it.

woj 01-04-2006 12:22 AM

you can charge back just about anything, but probably best to work it out with the seller...

try to remember that ANYONE can write up a T.O.S. and put whatever they want inside it. There are no laws forbidding how they are worded.

HOWEVER - here is the good part - if what the T.O.S says is in conflict with your rights in your state, THEIR state, the processors state or in the customer service chicks head - you win!

Like someone said, Call their customer service and state your case. I myself prefer emaling as this is 100 percent documented communication and time stamped. But at first contact, I guess you could call; making the assumption you will be treated as an honest person making a legite complaint . If it doesnt go your way on that call, then continue the process thru emails only.

It will be VERY beneficial to you if you can site (or cut n paste) from a specific URL and specific portion of text where what the SALES PAGES promised verses what you experienced AFTER THE SALE. This is especially helpful where the full version of the software was not available for a trial run. And thus you made the REASONIBLE assumption that the SALES PAGES were truthful, but upon payment and then subsequent receiving of the product, found that the sales pages LIED about the state of the software.

The TOS means sh!t put up against that line of arguement :thumbsup

good luck

spunkmaster 01-04-2006 12:31 AM

You have 6 months to do the chargeback and any TOS some third party processor has
is 99.99% useless to Visa/MC.

d00t 01-04-2006 12:45 AM

how much was the purchase?

anything under 200 you should just write off ... chargebacks will only ban you from 2checkout and their partners and they do partake in visaverified so you'll only be fucking yourself up
