Polk County Sheriff Claims Jurisdiction Over All Adult Websites
 

This is the guy who has Chris Wilson in his jailhouse this Christmas.

According to the Ledger, Polk County Sheriff Grady Judd said,

"Isn't it strange when people are charged with violating the obscenity law, they run and hide behind the First Amendment?" he said. "While they're running and hiding, they grab liberal attorneys, who make their money from the news coverage. People who don't violate the obscenity laws don't need the ACLU, a California attorney, attorneys for the pornography industry, and all other out of county attorneys, to defend them."

In response to the ACLU brief, Judd said, "I believe the obscenity investigation speaks for itself."

There are several people who live outside of Polk County who assist Wilson in running the Web site. When asked if they also might be charged with obscenity, Judd would only say, "The investigation is ongoing."

Polk County would have jurisdiction over anyone involved in running the Web site, even if they don't live in Polk County, as long as Polk County residents are able to view that Web site, Judd said.

"If obscene content is accessible in Polk County or Florida on the Internet, it's in violation of the law," Judd said.For the entire article, click here.

Its illegal for people to VIEW obscene content in polk county. If the distribution takes place in polk county then the distributor is also liable , BUT in most cases the distribution does not take place in polk county only the viewing , and that part is illegal.. so they can only charge the viewer not the website owner.. ( unless he is distributing in polk county )

I think what he was trying to say is that , other employees , even though they dont live in polk county could be liable if they helped distibute it from polk county to polk county.

He doesn't mean he can charge the owners of a website in afghanistan for porn that a polk county resident viewed.

Yup, a lot of countries around the globe have similar laws, this is nothing new to those of us who have actually researched the legal side of running a porn business.

Germany for example has some very strange (by U.S standards) laws concerning adult websites.

Why individuals who run an adult business dont do their homework when it comes to issues such as this is simply astounding if you are running a business in the 'porn' industry, you still need to ensure that you are running a solid business.

This case is tantermount to educating adult webmasters that they just cant upload a porn site and think its 'fun' it isnt, something as simple as a law enforcement officer hitting your site could potentially mean you end up in jail.

During the Regan years the Postal Service had its investigators place orders for porn VHS tapes from California. I don't remember what state they were delivered to but the Post Office routed the mail through very a conservitive county in Ohio. The government then charged the distributor in Ohio court even thought the tapes only passed through Ohio and were not viewed there.

I don't recall the ultimate disposition of this case but I think the sheriff could and would be very happy to charge others in this case and then let them fight it out in court for 10 years.

what crime would they have charged them with that took place in ohio ? i have never heard of any state trying someone for something that never took place in their state.. the prosecuter has to actually name a crime.. the state laws aren't valid in other states..

While I don't agree with the Polk County mounty on this one, I will have to say this:

There is nothing in the books, law or judgement, that says he is wrong. Nobody has tested to find out if we are subject to the community standards of the RECEVIER or of the SENDER, or if the internet as a whole has it's own community to judge from.

If you send an obscene video tape into polk county, they could charge you and I suspect they could make it stick. I think their logic is "the delivery method isn't important, just the product". Until someone proves them wrong, they are free to go about and lay charges based on their view of the law as it reads to date.

It isn't going to fly, but they sure could use it to fuck some people up in the mean time.

this just happend with the case against extreme associates. The ordered movies and had them shipped to a conservative pittsburg so that they can charge them in that area.

The supreme court ruled in the COPA case that local community standard can be used in internet cases so if you run a site from your office in Los Angeles you can be charged in Ohio. So far they haven't done that, but there is bound to be a test case one of these days.

They can do what ever they want. They can issue a warrant for your arrest and they can extradite you from any State. You might win, you might go broken paying the legal fees. These folks are for real we have had experience with them and will not accept content nor sell memberships in that county.

it also happened a couple ran a site in CA and got put in jail in TN.This was in the early days of the net. Another thing someone else posted offshore servers dont do shit if the money comes back in the the us. You have to move whereever the servers are. Polk county is a fucked up place and I hope this teaches others you just cant do a adult site where ever the fuck you want. You have to be aware where you live. I dont think he is going after anyone out of polk county ,their thing is they dont want people running adult sites or porn businesses in polk county.

Freedom of speech is the cornerstone of democracy and people have died defending it. This asshole speaks of it as if it were a loophole. He should be brought up on treason charges.
