The only time you get sued over a domain is when you refuse to give it over. Worst case scenario you hand it over. Ultimately if you are promoting Sony PS3 merchandise on the site it is quite unlikely that Sony would want the domain.

I have dealt in many TM domains in the past and have quite some knowledge on the issue. If you are not interested in these domains then fine :-)

FYI ... sonyps3.com is attracting almost 100 direct type-ins per day..... this has risen from zero almost 6 months ago.... I can see this reaching approx between 5000 and 10,000 when and after the console is launched :-)

Sonyps3.net is attracting approx 1/20 of that.

I have experience in buying and selling domains that have had potential TM issues. Trademarks and TM domain names are definitely linked to one another but in my experience ( legally and in previous sales ) there is room for Manoeuvre if a legal issue arises.

I have dealt with a few blue-chip companies in the past and I have lost only a couple of domains for zero $. In most instances we negotiate a sellback price. TM domain sellback prices tend to be cheaper than legal costs for most blue-chip companies. It just depends on who you are dealing with.

Sony could easily make the case that since you are using TWO of their trademarks you are using them to confuse....a big ICANN no no. Also I dare you to show that you registered this domain name in good faith....where is your content?

If this was ever taking to dispute you would lose, there would be no buy back.

And yes... I know a little something about ICANN domain dispute resolution that is why I am commenting.

you can't legally profit from that domain. i guess the smart thing would be to sell it to some sucker. i could see if it was ps3forum or something but you're using the Corporate name and there product... what can you possibly put on that site to make a profit and not get sued.

I always laugh when i see the sig whores jumping on not only my threads but also other serious threads on this board. I understand why they do it but it's still funny.

It's also funny the amount of domains I sell on here to REAL domain buyer's and sellers who never post but email me directly instead....

Veteran's Day.... it's not luck, it's just that most big companies don't care.... ( your point serves to prove my point)

Many of today's major parking programs have all the major companies on their books and so long as they are receiving the traffic and getting sales they don't seem to mind so much. There are exceptions of course.

I have a very large list of TM domains that i park and many of them lead directly to the company homepage of the domain people would suggest (correctly suggest perhaps) that I am infringing upon....

This TM domain falsehood is exagerated by people who don't know about domains. I see it all the time. The people who actually specialize in domain moneterization realise that although TM domains are risky there is still enormous value and potential in them if you know what you are doing.

Anyhow, i am sure Franck has much more to say about his specialist subject so I will let him take the floor....

Interesting, when I asked lanclan how much he sold it for he said it was a lot less than he wanted cause he had to get rid of it. When I asked him why, all he said was he got a letter from Microsoft and didn't want any hassles. Funny, the google cache of the domain still has the logo banner that lanclan ran a contest for in here and then never paid for. http://www.whois.sc/halolive.com

to be honest, I'm not sure if his story would have been true. I have had this domain for at least 1 year now and i haven't heard anything. I also think it is unlikely that Microsoft can trademark such the generic term HALO or LIVE or phrase HALOLIVE.com

If the matter did go to court chances are they would win it since they could pay for expensive lawyers and issue threats of this and that etc. However, i would be very surprised if Microsoft ever contacted me about this domain. It would be difficult to enforce this as a TM... in fact I would imagine that HALO is not even trademarked....

Having a trademark doesn't mean you can actually enforce it. Look up trademarks for "love" and "apple" and tell me all those people can sue each others' asses off. You can TM anything, enforcing it is a different story.
