a question to content shooters & buyers
 
Here's the drama:

a guy owes you money for over a year on content, almost 2 years, that he bought, stalls and stalls and one excuse after another: "I'll pay ya next week" "I'll hit ya up with the $ on the first" "I got a big check coming in, then I'll pay ya" "yada yada yada, etc". . . .

So the fucking guy now tells ya that if you'll sign a "work for hire agreement" on the 250 sets that he never bothered to pay ya for, that he'll get the check right out to ya . . .

What do ya think guys? Would ya do it???

I'd have already contacted my lawyer and outed this guy to other industry people so they know what to expect... You may not be the only person who's been given this treatment. Let it be a lesson, get at least half up front every time :)

this was someone that was supposedly a 'friend' this is why I've gone so long with it . . here's the funny part: the reason I wasn't getting paid is because he took the money from the sales aof my content and started buying content from another producer . . and he owes that guy $$ too. can you fucking belive that?

I'm hoping that he'll take these 'hints' here and setttle up like a fucking man and we can all move on . . if not it should get very interesting around here for a bit . . . the other shooter gave him until friday to pay

Exclusive content is work made for hire, but he should have asked you for paperwork when the content was shot, not after being a late pay. At this late date, he should settle up his tab and expect you to sign after his check clears. If he doesn't trust you to be selling the agreed rights after he has not paid as agreed, then that just reflects on his intentions and you probably shouldn't sign.

anything "work for hire" is a transfer fo ownership - be careful you do not sign over your copyright and/or ownership doing this

But what if the real story was that the guy has already paid you $28,380 and owes $2,500 more and is asking for a work for hire agreement because he doesn't own any of the content without it? What if that was the real story? Would that change anything?

So out of a total bill of $30,880 he's paid $28,380 which is 92% of the bill. And yet he still does not legally own the content because he doesn't have the work for hire form.

And let's say the other shooter was paid $1,100 out of a total of $2,880. And the second shooter hasn't signed a work for hire either.

Those facts might possibly change things, wouldn't they?

beats me?? but when a guy blows you off for so long . . . any way I'll sign the WFHA as soon as the check clears . . problem solved :thumbsup

Just got your email. This is a tough one. You were really nice to let it go this long. I have a good friend that does the same. let's things slide for a long time. Sometimes it works out and he gets paid. I'm much more agressive when it comes to our money and I'd probably come out blasing and tell the guy it's pay up or kiss the content goodbye. Any chance you could revoke his license on the content?

Hi Shap . . nice to see ya here . . the only problem I ever had shooting was the shoot I fucked up for you :) please accept my public apology at this time, hopefully we can do biz again at some point. And yes this whole 'tuna' is a regrettable mess . . . Brian

Hey Brian. This how i look at it. A photographer and model walked into that shoot. One of them came out and kept doing business as usual. The other came out, quit the biz, shutdown their site and left 100s of webmasters high and dry. Obviously the one who quit wasn't you. I understand shit happens and I've heard so many good things about you from Dean :winkwink: Apology accepted!

Hopefully we can get around to doing some good biz together in 2006 :thumbsup
