I feel like I've been ripped off. [serious drama thread]

I've tried contacting these people privately and it seems they're unwilling to discuss business now. So I'm forced to this level. I don't take matters such as this lightly.

I'm a photographer. I make money selling my work. I got an offer from Quashe, David (Krome), and KC with AdultLabel that would allow me to have a paysite under their program, all they needed was the content. The deal was that I would see 20% of sales, in exchange. The site is 18to22boys.com

That was back around January of 2004. We're now in December of 2005 and I've never seen a dime from this deal.

They were very helpful when it came to taking the content from me, but now none of them return ICQ's or emails regarding payment. About a year ago, I had David call me and talk to me personally about this issue. He explained that since the site was softcore, he was unable to sell the site with his marketing efforts. He said if it was hardcore, it would sell... and he wanted me to shoot some hardcore content. I happen to run a softcore site myself and know that it sells decently.

This company has never let me verify sales data with CCBill. That was part of the original agreement. They said they'd get the login info to me, but everytime I've asked for it they avoid the question and tell me not to worry about it because the site isn't selling.

A company cannot reasonably expect to be able to use a photographers content free of charge. I am not running a charity service. I operate for profit just like anyone else. And besides that, I have models that I've paid a considerable amount of money, and I need to eat and my bills.

At this point, I feel cheated. I feel abused. I feel ripped off. I honestly feel like I'll need to sue this company if I want to get paid. I'm not asking for much, just $2500 and we'll call it a done deal. I'll consider this a learning experience, and you won't owe me anything more.

The check can be mailed to:

Serial Media
PO Box 864
Rocklin, CA 95765

Otherwise, you can expect to recieve a letter from the court stating that you're being sued for this sum by my company. I figured I'd be generous and save you some time and money.

You should have agreed a fee + commissions, that way you'll never do work for nothing incase the site is a flop (like this one)

The deal is that they handle the marketing, and I handle the content. Either way, I don't do charity work. I've lived up to my end of the agreement.

EDIT: I missed another reply....

There should **ALWAYS ** be a written contract in place between all parties to cover the scope of the project you are both involved in together.

If you choose not to have a contract in place that has a specific roles and responsbilities listed there of all parties, be prepared for the worst possible.

This isn't so hard, if they are using your content without a license, I'm sure your attorney can figure out how to handle it very quickly.

Roald 12-06-2005 10:06 AM

There is a message on your voicemail to get your ccbill info.

To be honest I was sure David took care of this some while ago. I am sure this will be solved asap.

Kevin left me a voicemail.

If David assured you this had been 'taken care of', then he was mistaken. David did NOT take care of this some while ago, or else I'd be here with a check in my hand. If I didn't feel like I had been taken for a ride, then I wouldn't have created this thread.

And I most certainly wouldn't have started this thread if I didn't feel something absolutely wrong had taken place. This is one of those moments when something just needed to be said.

I hear you, like I said I was sure it was taken care off. I agree though, this should have been take care of long time ago.
