Who here has taken someone to small claims court in Ontario?
 
and do you have and pointers..or a link to where i can read up on the process and anything else that might be helpful?

thanks guys...im going after my wedding photographer

he didnt stay the 6 hours we paid for..and missed our reception...my wife doesnt speak perfect english so they are sayign she opted to not have about 1/2 of what we paid them for done.

none of the pics are centered...no pics of our family together..nto one pic of my sister...and the guy stayed 1/2 the time...as well as he missed the reception

yeah i went through www.piperstudios.com

they sent over this dude who was about 60..didnt speak much englsih..was missing most of his teeth and begged me to leave about 10 times in 2.5 hours

i want at least half my money back...my wife wants it all back and more..lol

ill settle for half the money back as we only got half the time we paid for

No matter what happens in small claims court, it's not like you can relive that day again.

Something like that would have devastasted my wife. Marrying me was traumatic enough.

yep..she is so upset it is not funny..alli hear about everyday is..where is the photo money..when are you going to get the money...and when are we taking them to court..and where is the money..lol

if i dont get them into court soon she'll have me down there choking the fucker

Phoenix, you should have just found a reputable photographer man. A research before you get a photographer could have saved the day. It's a very important day of your life. You shouldn't just get ANY photographer. Anyway, winning at small court isn't hard but collecting money is.. but go ahead and sue just to let him know what he did wasn't appreciated. Good luck!

that absolutely sucks...really sorry to hear that. You should be able to get Legal Aid.. if not.. you can call them up and have them step you thorugh the process. I have done it, but used a lawyer

Sorry to hear about your problems, There is a $50 filing fee, and all of it can be done by yourself, look it up in the gov pages in your phone book , you dont need a lawyer for this. :2 cents:

You probably won't even make it to court. You'll go to a pre-trial meeting with you, the photog and a judge. If the case is clear cut (and it sounds like yours is), the judge will *strongly* recommend to the photog that he pay your damages. If you *do* end up going to court, make sure you ask for all your costs as well (on top of the damages).

Good info - that's pretty much the way it works. Years ago we went after a contractor who'd sub-contracted some work to us. After we finished the job, he claimed he was never paid by the customer - so in turn couldn't pay us. We were out a few grand in materials and labour, and filed against the contractor in small claims. We met in private with the judge and got a settlement without going through the court motions.
