    Is this legal?

    I was searching through internet jobs, and I saw this in the ad:

    No Tobacco Users

    Tobacoo users, including users of smokeless tobacoo products, are not eligible for employment with National.

    Is that legal?

          it's illegal in some states that have passed laws banning discrimination based on legal activities in off-hours; in other states, it's questionable and could be challenged in court, but not necessarily illegal.
