Could that be considered as an overload on a Pentium 4 at 3.0 GHz with 2gb of ram and 59mbit of burstable BW (we are burning like 10% or so) ?

The guy i am sharing my hosting with thinks that this is too much and he is threatening me to remove my sites if i dont remove them by myself in the next 24 hours.

That is really nothing to worry about, generally once it goes up to 3-4 range you have to worry. Being on a shared server 1.2 is pretty normal, i have servers that we have has in the 12-14 range during peak loads, but they are load balanced so it was easily able to handle this.

Server load isnt a great indicator of actual load. Look at 'top' and get an idea of whats eating up the resources.
