Bar Owner Sent To Prison After Drink Kills Patron

HUTCHINSON, Kan. -- The former owner of a bar in Kansas has been sentenced to nearly four years in prison, for the death of a woman who died of alcohol poisoning.

Prosecutors said Juanita Goodpasture, 31, died after she was served a red, yellow and green concoction called the "Stoplight Challenge."

The $15 drink was so potent that prosecutors said people who bought it were given their money back and a T-shirt if they could remain coherent 30 minutes after consuming it.

Billy Scott, 34, apologized to Goodpasture's family at his sentencing Thursday. He was convicted of involuntary manslaughter last month.

Goodpasture had a blood alcohol content of 0.43 when she was found dead at her home in July of last year.

.43 off one drink? I bet there is more to the story then that.

.08 is LEGAL Limit in Florida which is 1 beer per hr if avg weight ect ect ect.

RawAlex 10-28-2005 10:18 PM

.43 isn't hard to hit, really... the trick is that is it hard to hit while still standing.

Let's say she had 3 beers an hour for 2 hours... she is already at something like .20 or so... now she has the "special" drink... say it has 6 shots in it... she could easily top out over .40 without even trying... 6 shots would be enough to push her up to almost 0.60 or even higher....

If the drink had 6 shots in it, there was a 0.48 or so right in there. (1 shot same as 1 beer per hour)

You don't know #'s and BAC levels do you?
.60 = DEAD
6 shots isn't .6

An autopsy revealed that McCue had a blood alcohol level of .44 percent. Witnesses said that he drank 24 shots of liquor in less than two hours. He died of acute alcohol intoxication--also known as alcohol poisoning.

Friends had taken McCue out drinking to celebrate his 21st birthday.

How Much Alcohol Is Lethal?

Most authorities agree that a lethal dose of alcohol is about 0.40 percent, or about five times the 0.08 legal limit of many states. Death from alcohol poisoning may occur at much lower levels, however, especially with inexperienced drinkers. For a 120-pound individual, it would only take about nine to ten drinks in an hour to reach the lethal level

Had to do some research -=x

"Scott was convicted of involuntary manslaughter last month in the
alcohol poisoning death of Goodpasture, 31, who had a blood alcohol
content of .430 when she was found dead at her home in July 2004 after
a night of drinking with her mother and sister.

"A lot of us are at fault, including myself," Goodpasture's mother,
Bev Brown, told the court. "But he took a life and I think he should
be punished for it.""

that's right hahahaha... pass the blame.

I agree and disagree at the same time.

You can die from drinking to much water. You can die from eating to much.

Granteed it's quicker to die from drinking Alc. If I head into a bar if I get too drunk they cutt me off.

KMR Stitch 10-28-2005 10:31 PM

They have a 72 ounce steak you eat it it's free + fixings..
There is in and out burger 20 fucking burgers/cheese
5lbs hamburger contests if you eat it it's free ect.

Matt 26z 10-28-2005 11:37 PM

If I bet you that you can't beat the train at the crossing and you get hit, who is to blame?

It's too bad the bar owner had to take the blame because dead people always get bonus points. Fact is, this was one stupid bitch who ASKED FOR IT.

Honestly why is the onus never on the person who actually put *themselves* in the stupid position?

I mean come on - this is just ridiculous. The barman cannot be held responsible for everyones actions in his establishment. That's insane. Do school principals go to jail because on of their students commits a crime during school hours?

I said 6 shots ON TOP OF ALREADY HAVING OTHER DRINKS... 6 shots is (based on the calculations of 0.08 being 1 beer, 1 shot, or 1 glass of wine in an hour) about 6 X 0.08 or about 0.48 - and this all taken in one major shot. DIscount it a bit for spillage, short shotting, etc, and you can easily find 0.3 to 0.4 in this one drink alone.

Combine it with, say, 3 beers in the same hour, and you are looking at BAC of anywhere from 0.4 to 0.6! Remeber too, they found her dead at home. That means there was a digestion period and a "wearing off" period before the death. 0.40 or greater dead would suggest a BAC of over 0.5 at peak.

Because this drink appears to be large and would appear to need to be consumed in a fairly short period of time (for the purpose of a contest), you can safely assume that the girl likely had a HUGE peak BAC rating that would certainly register as dead. Remember, SHE DIED.

0.60 is NOT out of the question, pre mortum. the actual time of death compared to the time of consumption would allow you to pretty much figure out a straight line to her peak BAC. It was certainly a stunning number.

Thank the govt that made alcohol legal to begin with.. its so fucked up.

google "dram shop law" and see what it has to say. I remember when I bartended/waitressed in Austin 18 years ago..I had to take a test and get certified and I could be held responsible for serving someone if they left the bar drunk and got into an accident resulting in injury to another.

That's ridiculous - especially since most bar tenders are young kids (not saying this is you) which usually implies a bit of irresponsibility..

Personally - if I do anything stupid etc after drinking at a bar then it i ME to blame no one else. Stupid laws like this prove that law makers are imbeciles.

I love seeing people pretend to look like they know what they are talking about. Blood alcohol level RISES over time and does not 'wear off'.

stevo 10-29-2005 01:15 AM

Whats the recipe? I want to challenge a few friends :)

AlienQ - BANNED FOR LIFE 10-29-2005 01:20 AM

Not to mention some people actualyl have a pretty intense alcohol tolorance.

.6 is not always dead but driving on the highway believe it or not, there are some pretty extreme cases out there in the news.

"a night of drinking with her mother and sister"

Did her mother and sister receive t-shirts?

WRONG Search the mythbusters Esp. Where they had "fool the breathalizer"

6 Drinks x .08 = not how you Figure out BAC
That means if I drank a 6 pack in an hr I would be at .60 DEAD

I can drink 12shots in 1 min. And that would be what? .08 x 12 = .96%?

BAC = % of ALC IN blood.

lol

wrong. its called Water Intoxification (hyponatremia) and it happens quite a bit. Usually happens when someone goes from a state of extreme dehydration and then drinks an extreme amount of water (1-2 gallons) very quickly.
