can apple sue me if I sold ipod nanos for $230?
 
I'm getting shipments of ipod nanos in a couple weeks...do you guys think apple will sue me if I sell them for $230 which is $20 under the MSRP?

could any company sue if I'm underselling everyone?

I'm not selling them at a loss or I wouldn't be selling them.

But the margins are getting smaller now htough.

2 weeks ago they went over $300 a pop on ebay because every single apple store sold out of them...including apple.com

the reason I was asking the question was because I remember reading an article where stores were sueing another company because they were undercutting everyone and killing sales.

I will say though that if you get over 5000 units you can buy them for $135/unit. That'll give you guys an idea on how big Apples margin is...its probably a lot lower i bet

You can't get in trouble with a company for selling under cost unless there is something in your contract or agreement about it.

In 2001 we battled this out with Mattel. My argument was if Wal-Mart could sell under toys under cost why couldn't I? Mattel is run by a bunch of assholes, so that was a lose lose situation....

You should be fine though!

$249.99 is for the 4gb version

A retailer does often have contractual obligations to the manufacturer on how they can sell the items.

You see this often on electronics, particularly popular ones, however, this can border the line of price fixing.
