{Personal Rant} Just got outta jail for Domestic Battery... Bullshit law!!!
 

So here we are, me and my live-in girlfriend at 2am in the morning arguing about a cellphone. I have a super nosey neighbor. The type that cracks her door open everytime you enter the building. So, while arguing. I see 4 police cars outside the window. They ringing doorbells and as I walked into hallway. I see my nosey ass neighbor letting them in the building. They confront me in the hallway. I'm telling them me and my girl are just having a lil argument and assured him that it will cease and we will calm down. He proceeds to ask my girl did I hit her. She say's no. Then he starts to talk about Disorderly Conduct so then I start to tell him there's no reason to be an asshole cop. Cuz I already assured him that the noise will cease. So we exchange a few more heated words and he asked my girl did I assault her again. She says no and soon as I say to him "She said no, now BY!"... He flips my left arm in the air and slapped a cuff on me, then his partner grabs my other arm and slam me in the handcuffs. His prick ass proceeded to say "She doesn't have to press Domestic charges on you. I'll do it for the state cuz you're persuading her to say no". He roughly dragged me to the squad car and within less than a minute I was on the road on the way to the station. They charged me with Domestic Battery. I stayed in lock-up for over 24 hours. The next day at bond court my girlfriend showed-up and told the judge I'm in front of him for nothing. The judge gave me a I-bond... But I still gotta go to court for this shit...

I feel my civil rights were violated. Why? maybe cuz I'm black... End of story.

reminds me of situations with my ex. cops used to come all the time. luckily they never took me in though. had some close calls. the cops were straight dicks though and treated me like shit when i got taken to the drunk tank for fucking walking home...

I talked to him like a respectful human in the beginning but he just baggered me into talking snotty. Even while I was trying to talking with respect. He place his hand on my arm talking about "I'll appreciate it if you cooperate". Why grab me and talked hard? His main goal was to provoke me to jump outta character to give him a reason to arrest me. I understand his role as an officer but he also gotta use moral judgment while on duty...

That cop was provoking you. No doubt about it. And I can't imagine how hard it would be not to do what you did.

There is a big difference between speaking in a 'civil manner' and being 'respectful'. If the story went as he told it, was he being civil? I think so. Are there dickbreath cops that will try to push and act like imbeciles just to get a reaction from you? Yes. does that mean you need to take it and be 'respectful'? I dont agree with that.

That is why it helps to know the law. If you speak to them in a way that they know you know your rights, that shuts them up. In other words, you just outsmart them. Yea, yelling at a couple of a half-wit cops isn't going to work. You tell them - in the scenario above - that you answered their questions several times as did your girlfriend, that you believe this is turning into borderline harrassment, that if this continues they need to call their sargeant on the scene (by law, they are supposed to do that. they dont like it but you can request a superior and they need to comply) and you need to call a lawyer as well.
See if that works.

No, you don't know police procedure.

The cop wasn't provoking you he was getting close enough to smell whether you smelled like alcohol, pot, crack or whatever. He was also seeing how quick you lose your temper which is an indicator to him that you do lose your temper quickly and the complaint was justified.

Cool is cool all the time. Even when someone is that close in your face. All he knows is he's called to a domestic situation which is the most DANGEROUS of police calls and cops do-not-bullshit when it comes to those situations. When he approached the building he did three things:

1.) listened as he approached in the car to see if he could hear your ass arguing

2.) Stood outside the building to see if he could hear your ass arguing

3.) Entered the building to see if he could hear your ass arguing.

If he heard you while he was in the car, pay the disturbance of the peace charge.

If he heard you while he was outside the building, pay up.

If he heard you in the hallway at the door of a neighbor's apartment, pay the money.

If you showed your ass during the interview process, pay the money.

Plain and simple.

The officer is responding to a complaint and a possible RESCUE. Domestic situations are the most DANGEROUS.

I've lived in the most dangerous neighborhoods in the U.S. and RARELY ran across a cop who didn't know how to do his or her job. I know my rights and have more cops in the family and friends than I can shake a stick at. Was raised by cops too. In all those years I've run into a little more than a handful of cops who didn't know what they were doing and I handled the situation as I was trained to. They either lost their jobs or got corrected and were back on the job better at it.

You don't get into an antagonistic fight with the officer. If he's acting like an asshole, let him run with it, that's more ammo for your attornies and the investigation board of their IA.

You're the citizen who they're supposed to protect and serve and they have the charge to uphold the Constitution. You're the customer, but they're the appointed officer to 'enforce' the law. If the law says 'arrest antagonistic kid who smells like pot' then they 'enforce' that law.

If the law said to arrest anyone wearing a turtleneck sweater, they arrest people wearing a turtleneck sweater.

They have only a small margin of 'if' they feel the law should be enforced.

You should have said "Thanks for coming by officers, it's just a small matter of my girlfriend running up bills on the cell phone, you know if you've got kids how that can be. Women, you can't live with em' and you can't live without em' Chuckle, Guffaw, Chortle, Giggle."

And he would have said "Okay, but if it happens again I'll run ya in. Since your girl says there's been no physical altercation and I, at a glance and a brief interview, determine this is to be the case I'll letcha' off with a warning."

You then say goodnight, thanks, and get some new pussy.

I would have thrown you in cuffs right there.. remember a ticket and a warning is a courtsey.. anything is jailable.. if you jay walk they can take you to jail.. always remember that and there is a thing called officer discretion... I was pulled over on the strip doing wheelies with 3 bench warrents and did not go to jail you know why? cause I was respectful no matter how much they disrespected me and I also kept a level head I did not say anything to piss them off.. looks like your mouth wrote a check and your ass cashed it at the station and in lockup.... it will more than likley be dismissed but you should have kept your mouth shut.. " yes we were having an argument I did not realize it got that loud.. I apologize and it's done now" say nothing else till he talks to you... no matter how close he is to you...

lol @ dennis rodman. And you gota show the cops respect. I been in some situations recently where I just kept my cool (getting pulled over for running a stop, that kinda crap) and they just let me go. Of course I am not black so I donno if that has any effect on the outcome.

In those days women, kids, old folks and even guys were getting their teeth kicked in on a regular basis. The cops couldn't arrest the perpetrator because the victims
wouldn't file a complaint. Then some GENIUS finally realized that they wouln't file a complaint because THEY WERE AFRAID!

It was an act of TERRORISM.
