ABC NEWS CONFIRMS INDICTMENTS TO BE ISSUED FOR GEORGE W. BUSH AND
DICK CHENEY

On last evening's edition of "Shop Talk from Plot HQ" for Sunday,
October 2, 2005, hosts Lenny Bloom and Sherman Skolnick reported
that
ABC News has confirmed there are impending indictments of both
George
W. Bush and Dick Cheney. The revelation was made by none other than
George Stephanopolis on the Sunday morning news show "This Week".
Stephanopolis proclaimed his information came from "reliable
sources".

"Without knowing it, we are working for ABC News, we are their
'reliable sources', Skolnick and Bloom said jokingly.

Skolnick and Bloom theorized now that Stephanopolis has leaked this
historical information, it is likely that the major networks
particularly, ABC and CBS, will begin immediately preparing news
specials on this potentially explosive story of these indictments.

"They are trying to prepare the American people so it's not a
shocker," said Bloom .

Bloom asked Skolnick how he saw the scenario playing out after Bush
and Cheney are removed from office. Skolnick has reported in the
past
that he foresees a three-headed government emerging for a temporary
period of time in what he has termed a "troika".

"'Troika' is a Russian word for a wagon pulled by three horses'"
said
Skolnick. "And I have surmised that will we will have a three-
person
administrative emergency panel made up of (Albert) Gore, the actual
President, not inaugurated, some (military) general, who is not a
war
monger and some other third person that they will select and they
will run the government in the absence of the presidency. In other
words, we will get into an emergency situation where an election
cannot do the trick anymore."

Skolnick also expressed his concerns on how the Bush administration
and those who control them, may respond to this latest development.

"I think our government will be discredited and swept away because
this stooge and scapegoat, George W. Bush, supervised by his father
who is not now an elected official at all, on behalf of the Queen
of
England and the Anglo-American aristocracy, has controlled what is
going on in the united states and so I am very concerned that they
may in the very near future create an earthquake scenario.

The technology to create earthquakes, man made, has been known for
at
least 30 years or more. California is perfect for it because there
are places where the oil has been pumped out and it's is a hollow
dome and sometimes they have forgotten to fill it up with water.
If
you send harmonic waves, HAARP, or whatever, that you will set off
an
earthquake, man made. And then the White House will claim there is
an
emergency and there has got to be Martial Law."

Skolnick also warned of a potential stock market crash with the
date
of October 19th, particularly likely to be the actual day. "I think
by the third week of October we may have another historical event.
October has been historically crash month.

It is in reference to the movie "Signs" sort of protection against conspiracy theories and the like. But watching the video clip of the ABC news story, hey, this might have some merit. Not banking on it, but there are some crazy stuff out there.

It's a reference to conspiracy theorists. A lot of people only believe what they're force fed on TV, and to them, anyone who thinks what they say on TV isn't true is a conspiracy theorist. You'll hear the tinfoil hat bullshit at least twice every time you try to talk about ANYTHING that they don't talk about on TV. A lot of people are truly brainwashed.

I sincerely hope that Stephanopolis is right, if he is I hope that Fitzgerald has some serious security guards and is not planning on getting on any planes. Some Americans who object to income taxes claim that the Sixteenth Amendment was never properly ratified. These people are commonly referred to as tax protesters. Claims calling into question the ratification of the Sixteenth Amendment cite factors such as differences in capitalization, spelling of words, and use of punctuation among the bills ratified by the various states. Another frequently asserted argument is that Ohio was not actually a state in 1913 because a Congressional proclamation recognizing the statehood of Ohio was not issued until 1953?although Ohio had been sending representatives to Congress and participating in presidential elections since 1803.

Another tax protestor argument is that even if the Sixteenth Amendment was validly ratified, it merely "implied" the authority for an income tax, without explicitly creating it.

The best-known proponent of the non-ratification claim is Bill Benson, co-author of the book The Law That Never Was. His arguments were used by the defendants in several court cases, and were rejected in each one. In one of these cases, U.S. v. Thomas, 788 F.2d 1250, 1252 (7th Cir. 1986), cert. den. 107 S.Ct. 187 (1986), the Seventh Circuit Court of Appeals wrote:

Thirty-eight states ratified the sixteenth amendment, and thirty-seven sent formal instruments of ratification to the Secretary of State. (Minnesota notified the Secretary orally, and additional states ratified later; we consider only those Secretary Knox considered.) Only four instruments repeat the language of the sixteenth amendment exactly as Congress approved it. The others contain errors of diction, capitalization, punctuation, and spelling. The text Congress transmitted to the states was: "The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration." Many of the instruments neglected to capitalize "States," and some capitalized other words instead. The instrument from Illinois had "remuneration" in place of "enumeration"; the instrument from Missouri substituted "levy" for "lay"; the instrument from Washington had "income" not "incomes"; others made similar blunders.

Thomas insists that because the states did not approve exactly the same text, the amendment did not go into effect Secretary Knox considered this argument. The Solicitor of the Department of State drew up a list of the errors in the instruments and?taking into account both the triviality of the deviations and the treatment of earlier amendments that had experienced more substantial problems?advised the Secretary that he was authorized to declare the amendment adopted. The Secretary did so. . . . Secretary Knox declared that enough states had ratified the sixteenth amendment. The Secretary's decision is not transparently defective. We need not decide when, if ever, such a decision may be reviewed in order to know that Secretary Knox's decision is now beyond review.

Federal courts have rejected appeals based on claims of non-ratification, and some now consider them "frivolous" suits that are subject to sanction. In Knoblauch v. Commissioner, 749 F.2d 200, 201 (5th Cir. 1984), the court held, "Every court that has considered this argument has rejected it." when that court was presented with an argument that there were defects in the ratification of the Sixteenth Amendment by the states.

A strong libertarian viewpoint proposes the existence of a natural right to "enjoy all the fruits of one's own labor" (previously protected, they claim, by the Ninth Amendment). Taxation is argued to be an infringement on that right, and this amendment is criticized as a major expansion of the taxing power of the federal government.
