Sergi said Kulhanek was put in a barbershop type chair where liquor was poured down her throat.

"Before she knew it, she was dead drunk," he said. "The people from Arco were egging her on to enter the wet T-shirt contest. The next thing she knew she was in front of a bunch of people with her shirt off."

so... let me get this straight, big strong brute force men must have FORCED her into this chair, taken a fifth of tequila and jammed it into her throat, draining it. she probably wasn't with 3 or 4 of her girlfriends, all of whom were doing this on some kind of bet/dare basis ... naww....

The poor little Angel .... then she just happened to FIND HERSELF on stage with her shirt off ... those bastards must have torn her clothes off and beat her until she went up there. Because on the FUCKING VIDEO SHE LOOKS LIKE SHE'S HAVING THE TIME OF HER LIFE!

sorry, I'm just pretty pissed to see yet another girl with a shark of a lawyer taking advantage of the system. I'm not saying that what the video makers did (as in taking a random chick and using her as their main advertisement) was very intelligent.. they're pretty stupid fucks too, should have gotten model releases from anyone they wanted to use in advertisements... but for christ's sake, I somehow think that the "conspiracy with the bar" was a little blown out of proportion.

And btw ... can someone explain to me why (at least I know this applies in washington state) if a woman gives consent to sex with ANY TRACE of alcohol in her system it's not legal consent, but a guy can be plastered beyond belief and it's still legal. grrr..

Here we go... Yet another chance for me to pick on your state and the screwed up laws that they have there.

As for this situation with the girl and the video. You are 100% right as I see it...Not that my opinion matters.

TaDoW 03-01-2002 11:39 AM

It's called peer pressure, and if someone can't handle it they shouldn't fuckin go party!

do you realize the precident this sets?? now a middle schooler can sue the shit out of his friends because they "tricked" him into trying ecstasy ... FUCK THAT

payrollpete 03-01-2002 11:50 AM

I wonder how quick this guy can move all his assets under an offshore company :)

eroswebmaster 03-01-2002 11:51 AM

This case doesn't mean shit...it's just the first round in 12 round heavy weight title match :)

I'm sure there will be appeals to follow as there always are...the two parties will eventually settle out of court for an undisclosed amount with no one accepting any blame or admitting any responsibility.

That's about it.

I don't think there's much wrong with your system, except the fact that OJ can walk free and ppl get millions of dollars for some silly shit like this. In finland if she'd won the case, she would have gotten MAX 5k$

I think it's better to pay too little than too much, as if you pay too much people start to whine from all the little crap..
My coffee's too hot! I didn't know how to eat a hot apple pie @ mcdonalds! Children are not supposed to play with plastic bags? etc etc...

This even was a good warning if you are going to be using pictures of somebody make sure they sign a contract first:Graucho

Scootermuze 03-01-2002 12:24 PM

It apparently wasn't the content of the video, but the fact that she was on a televised advertisement without her consent which gave her the ammo. Had she found herself just within the tapes content, probably not much she could have done about it.

But nonetheless.. every gal on that tv ad will be lined up now to try to get their day in court as well.

I think he already did. The five mill was a DEFAULT judgment, meaning he didn't bother to show up for court or send his lawyers or file an answer or nuttin'.

That usually means the defendant is sitting on a big box of gold bars on a Caribbean island drinking an umbrella drink and thumbing his nose at the procedings.

At least metaphorically.

RT- 03-01-2002 12:28 PM

Arco didn't even respond to the lawsuit.. it was a DEFAULT JUDGMENT. The court did the right thing, Arco fucked up and didn't take the suit seriously.

Scootermuze 03-01-2002 12:28 PM

Oh well.. just because ya win, doesn't mean you're gonna get paid.

Ha ha ha ha, this is toooo funny. At the end of the story on that link, it says this -

Wednesday's default judgment calls for Kulhanek to receive $2.5 million for emotional distress, $2.5 million for her privacy claim and $10,000 in attorney's fees. Sergi said Kulhanek plans to donate part of her judgment to a women's shelter.

I love that last sentence, how she plans to donate part of her judgement to a women's shelter, yeah fucking right !!!

Lawyers = GODS!!!

Lev 03-01-2002 03:19 PM

Only in United States something like this can happen. Go shoot somewhere else, like Ibiza island off the coast of Spain, you'll find good titties there :)

payrollpete 03-01-2002 03:27 PM

its going to be funny when the guy files for bankruptcy and has his assets moved to an offshore corporation.

then she will end up with a publically ruined life, and a $10,000+ attorney bill :)

payrollpete 03-01-2002 03:29 PM

lawyers lie out their ass...
"Kulhanek's lawyer, David Sergi, said Arco Media representatives conspired with bartenders to get pretty young women to drink alcohol and convince them to enter wet T-shirt contests. "We're hoping this sends a message to these pariahs that they can't booze (the women) up . . . so they really can't give consent," Sergi said. "It's really like rape.""

ROFL
yeah the lawyer cares about other women....

AHAHAHAHAHAHAHAHAHAHHA
That is the most crock of shit i have ever heard

SixNine 03-01-2002 03:32 PM

I'm surprised you don't see more of these suits! The footage may be shot in public, but if they don't have a signed model release then they are putting themselves in a dangerous position.

bhutocracy 03-01-2002 05:08 PM

i thought this thread was going to be about Courtney Love. :)
