Actually it is copyright infringement to post that cover of that book in your photos. If that is the actualy cover and not a mock up.

But, I am sure a guy who knows every copyright law would know that.

Haven't you ever been at a location to shoot and they tell you "You can't shoot any of the paintings on the walls"... same thing.

Back in the early 80s Iron Maiden released the album "Piece of Mind," on the album was a song that Steve Harris wrote that was based on a book by Frank Herbert. The song was going to be called "Dune" after the book, but Frank Herbert decided that he hated metal music and that if Iron Maiden called the song "Dune" then he would sue them and stop the album from coming out and doing everything else he could to cost them money and fuck them up. If you look on that album now, they ended up calling the song "To Tame A Land."

The moral of this story - if an author can sue a band for titling a song after his book then it seems to me that an author can sure as fuck sue for having the book shown in a porn shoot. :2 cents:

Close, but very different situations and if Iron Maiden did not back down like pussies they would have gottin more publicity and had Artistic merit in expressing there creative works and titling it the way they may have originally wanted!

80's Copyright Law would have found them free as a bird to title it anyway they chose.

Maybe, but I am sure they talked to their attorneys before they decided not to call it what they had originally planned on calling it. And if a multi-platinum metal band chose to avoid a costly legal battle then something tells me I would too.

Its a gray area to be honest, however anything to come of this is unlikely. I can only hope to get a law suit really!

See the book in the photo does not constitute a copyright violation because the work as a whole is not a derivative work in itself of the book.

There is not a court in the United States that would find otherwise. I mean I been wrong before LOL but on this really it is not likely.
