Going to Jail

With the new laws that are in effect in the US, is anyone scared of possibly going to jail for selling porn? Or is it not as risky as some people are saying?

fl_prn_str 09-13-2005 09:47 AM

nope....i have a card.

Going to jail is always a possiblility. Whether you are convicted or not, would probably hinge on where you are prosecuted and the community standards of that community.

If you deal in interstate transportation of erotica, you could conceivably be prosecuted in any town on the transportation path of the goods. Likewise, for the Internet, you could be prosecuted in any community where your website can be accessed. Whether a prosecutor decides to bring charges or not depends on several things:

Who made the complaint?

Whether the prosecutor has political ambitions?

What is the nature of the content itself and chances of getting a conviction?

What is the history of previous prosecutions for materials of this nature in the community?

Is the material in question already readily available in the community?

As you can see, the chances of being prosecuted depends on several variables. To that end we are all at risk everyday. However, given the reality of the situation, most prosecutors know that it is unlikely that they will be able to secure a conviction on mainstream erotica as it has become increasingly accepted by a majority of our citizens. It is increasingly difficult to get a concensus of jurors to agree on a pro-censorship stand in oppostion to the individual right to read and watch what they choose in their own homes.

That being said, we are still at risk in extremely conservative communities where local prosecutors have political ambitions, conservative groups are active, and where adult materials are not readily available or accepted.

The best advice is to use good legal counsel for determining your community standards and website design, be discreet in your delivery of merchandise, don't ship to places that are known for "obscenity prosecutions", be proactive in seeking answers to your questions, and join and support your adult entertainment trade association: The Free Speech Coalition.

Don't wait for a problem to arise.

I hope this helps.

No worries at all!

Americans love porn. It'll never be illegal. They may try but they will fail. :2 cents:

Great thread title.

Anything could happen that could land you in jail. A friend of mine's daughter was driving home from the beach, and hit some lady walking who had crossed the intersection on a red light don't walk. Didn't go to jail, yet, but, it could be a situation for her in court. Imagine just coming home from a day at the ocean and your whole life gets fucked up now.

Shit Happens

Nobody wants to go to jail and most never plan for the eventuality. But, it never hurts to have a "Plan B" in place just in case it is needed.

Doc911 09-13-2005 12:37 PM

most go to jail over taxes not porn

I highly doubt it would ever be illegal. COntrolled, yes, but not illegal

WarChild 09-13-2005 01:51 PM

The most important thing to remember to help you stay out of jail when selling porn is simply this: PAY YOUR TAXES.

fl_prn_str 09-13-2005 03:24 PM

you in jail yet? if so whats your bond? :helpme

stereolab 09-13-2005 04:16 PM

the guys who stayed out of jail spent a mint in legal fees to win the case (obscenity, pandering) . it always helps to have a lot of money. if they start going after small timers just to scare the industry, i don't think small timers could fight those cases. i wonder how much Rob Black ended up spending on legal fees

.

that's the real motherfucker. if you sell DVDs online and it gets into the hands of a cop in West Toiletseat, Oklahoma, you could be in a world of shit.

Spunky 09-13-2005 04:22 PM

Start practicing with the 10" dildo cause Bubba will rip you apart

Tat2Jr 09-13-2005 04:23 PM

Only shoot softcore, and pay your taxes.... that will keep you lower on the ladder.

In 1999 we were raided and charged with "Pandering, Assignation, transfering Porn over State Line, Having a business in a non business zoning, Sodomy (illegal in my State until Oct. 1999) there were a couple small once" It took us 3 years to get our computers back, and in 2004 we finally had everything cleaned up and out. In the meanwhile the City put a 100k Judgement on my home, what a surprise that was when we tried to sell it, another legal fee there.

It was very clear that I might have to go to jail and yup I was very paranoid. There was a huge sweep against Pornography in Maryland and VA at that time and a friend of mine did go to Jail for public indecency (flashing in a public bar)

After tons of legal blah blah, I received a 100 fine and was convicted for Assignation (since Sodomy was overturned by the time I went to court they had to drop that charge, we had tons of pics of blowjobs etc,, yeah,, thats sodomy too!!), I literally had to look up what I was convicted for. However I never went to jail received one year probation (that stopped me from shipping my Videos anymore trust me, no more buying my Vids online, the postoffice has no sense of humor)

I was also tagged by the IRS. They took all of my paperwork and kept it for month. I was cleared for any tax fraud (yup I pay taxes)

It was not something I would want to do again. Believe me,, no more parties at my home, Gangbangs at my home, the neighbors no longer know what I do, I don't tell anybody.. anything anymore. It was different in 1996 when I started, having a Pornsite was cool, until my religious neighbor thought I was bad for the neighborhood. Oh well!

:warning

christ, what a nightmare. i'm sure there are lot stories like that that just don't get media coverage. i browse the news sites using words like pandering and indecency and obscenity, it's amazing that these cases are happening, but nobody talks about it.
