Ticket for doing 100Mph+ in California

Getting a ticket for doing over 100Mph+ in Riverside/Indio in california is a mandatory court appearance.

If the cop doesn't show for this type of court appearance, is the case still thrown out, or does that apply only to normal contested tickets?

(p.s. i do plan on asking my lawyer in the morning, but would like to see opinions from GFY)

MrIzzz 09-11-2005 09:39 PM

the only time you are cool for doing over 100+mph is if you take pics of your speedometer and post them here :2 cents:

MANDATORY APPEARANCE

If your case requires a mandatory appearance, you cannot pay your fine without first appearing in court for arraignment. You can appear on or before your appearance date at any of the listed court locations. (Click here for court locations) Your courtesy notice will indicate MANDATORY court appearance.

The following infraction charges require a mandatory appearance.

22348(b) VC - Speed greater than 100 mph

So question still stands, anyone knows if the police officer not appearing still applies to this type of ticket as it typically does when you contest a lesser speed infraction ticket?

Anyone?

baddog 09-11-2005 10:01 PM

You will make 2 appearances

1. Arraignment - cop does not need to be there

2. Trial - cop does have to be there, if he doesn't show, case is dropped

abadfish 09-11-2005 10:11 PM

Wow... that blows. I got a ticket for 100mph in Texas but I just paid the ticket. It was like $300

throwdown 09-11-2005 10:14 PM

I dont think there will be any jail time for this type of infraction, am I wrong in thinking that?

A speeding ticket? I don't think you'll be incarcerated.

:1orglaugh

phonesex 09-11-2005 10:20 PM

My would you go to jail? Just pay the find, take online traffic school and move on.

My ticket resulted in a fine of about $600 and a suspension of my license. That was about 5 years ago so the details on the amount are hazy, and I was able to get out of the suspension due to some fancy footwork on my part.

wdsguy 09-11-2005 10:22 PM

haha u got busted in the 909, sucka.

wdsguy 09-11-2005 10:23 PM

if u are ticketed over 100 in ca its never good. I got ticketed for 92 going up on the 5, all I had to do was pay a fine and take traffic school.

But why would he fill all the paperwork if he's not planning to be there ...

put it on the gas pedal?

Cops usually plan all their tickets they hand out on a specific court date..so if they have 10 people contesting they will show up..if they only have 1 or 2 contesting they probably wont show..a gamble

Who in their right mind drives more an 100 MPH on a public highway? You should not only gotten a ticket for the speeding but you should have also gotten a ticket for reckless endangerment. Some people's children just don't have any fucking brains.

BTW, anything over 20 MPH can get you arrested and taken to jail, so if the cop just gave you a ticket, consider yourself damn lucky.

There is no online traffic school for violation of 22348CVC

22348. (a) Notwithstanding subdivision (b) of Section 22351, a person shall not drive a vehicle upon a highway with a speed limit established pursuant to Section 22349 or 22356 at a speed greater than that speed limit.
(b) A person who drives a vehicle upon a highway at a speed greater than 100 miles per hour is guilty of an infraction punishable, as follows:
(1) Upon a first conviction of a violation of this subdivision, by a fine of not to exceed five hundred dollars ($500). The court may also suspend the privilege of the person to operate a motor vehicle for a period not to exceed 30 days pursuant to Section 13200.5.

Just remember, $500 is the base fine, CA adds a 150% penalty assessment (or something like that). It will more than double the fine.

#1, you are actually lucky.... In the state of California it is a felony to drive 100 mph and you should have been jailed and the vehicle impounded (the felony is why you must show up in court).
#2, the cop must show because he is the prosecutions leading witness. Without their testimony there is no case because there is no evidence either.

Wrong:

22348.

Yes, I know I am lucky I didn't get arrested that night, I was cool with the cop, and the cop was cool with me, so it paid off.
The cop himself told me that he was justified in arresting me, and also put a note on my ticket and called ahead with a code that should I get stopped for any other reason while in california I would be arrested.

As of this time, I am out of state, so they had given me a 60 day extension on the court date, which is the maximum they allow, I will most likely hire a lawyer to represent me rather than fly down there for it.

I am not sure that they will allow that, but your attorney would know better than I.

Even if you wanted to just plead guilty, which could normally be done via mail, it is a mandatory appearance.
