webair.com has destroy 3 years of my work

Hi

WEBAIR INTERNET DEVELOPMENT IS ROOT OF ALL EVIL. WEBAIR.COM

I dont know if its right for me to post this story here, but
I think you all should know what webair internet development (webair.com)
did to me.

I am webmaster of linkdatabase.com (40K unique visitors daily)
and several other freesites and paysites.
Linkdatabase is 3 years old my personal project which I started in 1999.
I was webair`s costumer since October 2000, when I started linkdatabase.com
I was hosting at interland, then i moved to webair, because they tricked me with
many promises.
In friday on February 1st, webair inc, was suppose to remove one site under my account.
What they did is that they have remove my account instead of removing only one site.
They have remove all my sites, all my backups, all my papers all my files, entire data.
I have call tech support in same days (I assume 2 hours after they did that) I first thought
that I was hacked.
Tech support said we will check, I was first waiting 3 hours, then I have call back
to see if anyone is working on my problem, guy on the phone (he was from some 2nd company which
runs answering service) he said to me that he is trying to contact webair admin, but noone
of them is picking up the phone, then I left him a phone number where they can reach me.
I was waiting next 5 hours on response, noone has call me back, noone has respond on my emails.

They removed all my projects in friday at 2pm.

In friday at 11pm , I still didnt had anyone working on this case.
Ive keep calling them over night, now there was a women, she was not able to help me
because she normally works for billing department and doesnt have any technical skills.
She said that she left 4 messages on phone machines of webair admins and someone should contact
me asap.

date&time: saturday February 2nd, 3am .
I was still waiting on help from webair, I have start slowly realizing that
help will not come. I have start moving my sites away from server at webair to my 2nd server

.

when I have finish some work i went sleeping at 5am.

I have hope that when I will woke up at 10am, my sites will be up or I will have some messages
left on my answering machine.

When I have woke up situation was exact the same.
I start calling webair costumer support again, still same lady there as with which I spoke
over night, she said to me, she still didnt get ahold of any of webair admins.
I have ask if she knows when the usually woke up, she said they should be here in 30minutes.

I was waiting and almost started crying after i have realize what webair did, imagine
that someone destroys your biggest project in which you have invest 3 years of work
each day each week each month, each year.

Date&time: Saturday February 2nd 3pm.

first webair admin shows up and I receive email from him.
he said he will try to find who is responsible for this instead of
saying what I will want to hear
(we will backup your sites ASAP and have you running in 2 hours)

guy said to me, we have one backup, but its not here, I have start searching for some backup`s
it can take up to 10 hours.

I said well o.k soo much time has pass, lets wait 10 more hours and I will have sites
up.

After 15 hours I have check again, admin went off his shift and backup was still not released

Date Sunday February 3rd 6am.

linkdatabase.com is still down and not a single file was restored from webair`s backup.
I have call webair again, guy on the phone said that he will get someone to work on my problem
(Ive heard that 5 times already)

Sunday 2pm:

I have email webair, that if they dont restore my backup I will report them to ftc and bbb
I was very suprised how many people got involved after I said this.

webair admin working on my case has fw this email to his supervisor.
supervisor said stop immediatly all work on this guys troubles, since he wanna solve
problems his own legal way, we are not willing to help anymore.
We have been nice enough to start working on your backup (they are working 3 days already on my
backup, every person will get mad after 3 days)

Sunday 8pm.

I send one more email to webair`s owner, he said all questions regarding your troubles
should be directed to our laywer, we have been prepared to help you, but we have been
wrong since you wanna report us to FTC and BBB.

Ive sent him 2 more emails, saying that I am sorry, and I am not gonna threat them
with FTC and BBB , if they repair me this and restore my backup, but I have set a time
ultimate I wanna see some results
in 48 hours.

one more admins contacts me back and he says he has receive email from his
supervisor to stop working on my case.

Monday February 4 1pm.

Situation is exactly the same as it was in Friday on February 1st.

Ive got over 20 emails from people asking me what happened, Ive had conversation on the phone
today with laywer working on internet law I had conversation with owner of
hostmansion.com webhosting company.

I have ask them if I report webair to ftc and keep working on case supplying them
with more and more info, is there a chance that I win ?

Both said yes, since I had soo much info againsts webair, that ftc would be interested.

Monday February 4 3pm.

Ive got an idea, what if webair doesnt have backup and they only promise backup service
on their order page in reality they dont have anything? This can be possible too.

Webair account supervisor, contacts me back and says that someone is working on my case.
all sites are already up on my other servers (these servers are for thanks god not
located at webair), except linkdatabase.com I only have
(full links&category mysql backup) but all html files, banners, logos, photos..etc are missing.

I start doing backup of mysql data, I cant afford that webair
screws this one too.

I keep waiting and start writting report for FTC and BBB
until now I have collect 9 url`s of webhost listing
sites where webair is listed I am gonna post bad
reviews about them everywhere

This is last email ive got from webair`s owner:

No one is working on this matter because the client physically threatened
tech support personnel .
Any and all
correspondence from this client should be sent to [email protected] I gave
the client every opportunity to comply and all he did was harass everyone.

If you ever had problems with this company (webair.com)
and you dont have time to write report, tell me your story and we can report them together
this company has cross all the lines.!

If you know anyone who is looking for webhosting company, please warn him not to choose
webair.com

Thank you

Oliver

WOW man, sorry to hear about your situation. I have never ever dealt with webair, and I certainly won't in the future.

I have a question though:

Don't you have your own backups stored somewhere ? If so, why don't you just move to a different host ASAP instead of messing around with those fucks ?

redshift 02-04-2002 12:01 PM

I know that you are upset with webair but you have learned a very valuable lesson - which is: BACKUP,BACKUP,BACKUP

Jakke PNG 02-04-2002 12:07 PM

Life's a bitch and then you die.
Sorry mate.:(

Speedy26 02-04-2002 12:14 PM

i new there had to be more to the story...

mattemus 02-04-2002 12:17 PM

I hate when this happens.

Long thread but i have learned something from it:
BACKUP BACKUP BACKUP

traffic101 02-04-2002 12:53 PM

webair belives that we violated dmca, which we didnt, I have all copyright contracts that I can legalyl use content on my sites and they have been also contacted by company which sold us all this material.

I will provide these contracts to FTC since they will do investigation.

PlayaPlaya 02-04-2002 12:53 PM

Sorry to hear that man, but redshift is absolutely right, u should definately back up all your work just incase of incidences like that. I run a host of my own and I know what kinds of things can happen, as everyone else that works with the web. It could of been an honest mistake that some1 made while attending to your account, But completely disregarding you is wrong dude. Before i started my own host, i had incidences similar to yours and I know how it is.

Good luck to you man

From the owner of WebAir.com in response to Oliver's false accusations;

Oliver Rodela (linkdatabase.com) has been a client of Webair's for over 2 years, last week he was reported for multiple DMCA violations which were reported to him by our legal department. Mr. Rodela did nothing about removing the unlicensed, copyrighted material from his site. We have e-mail correspondence verifying this and showing Webair was well within it's rights to terminate this client. Additionally, Mr. Rodela physically threatened our support staff on multiple occasions after we took his site down due to these copyright violations. Webair's TOS are very clear regarding the pirating of stolen content, and we stand behind our decision to terminate Mr. Rodela's sites. It was our decision based upon his lack of response to remove the illegal content that he was displaying on his site. I regret that a client Webair's for over 2 years has put himself in such a precarious position. I also regret that he has stooped to the level of such slanderous accusations. Rest assured that his allegations are preposterous, and that our services are better than they have ever been.

I have all copyright license contracts, which I will provide to FTC, their agent has already probally contact you if not you will be contacted tomorow.

If you will ask me for contracts and bills I will show them to you too, but you have remove me without a single notice.

FreeOnes 02-04-2002 01:18 PM

Too bad that you got thru this hell, at least you have learnt one thing: BACKUP (or did somebody already said this? )

Wiredoctor 02-04-2002 01:22 PM

Hey Traffic 101, at first I was on your side, but if what Kman said is true, then I would gladly stand with him and give you a ass whoopin you would Never forget. Oh and I'm from the old school, where I was tought while in training to NEVER fight, but if pushed into the situation where I could not back out, then there is only 1 rule. No if you are in the right, then it's webair that needs the whoopin...

APIC strikes again but is it a mistake?
are the dmca accusations true?
will the linkdatabase engineer pull through?
and what about webair are they in the wrong?
did webair ask for proof of ownership?
whois to be trusted?

tune in next time for all the answers!!!

Reported by whom? In reference to what specific material/pictures?

I will believe that when I'm told who the copyright holders that complained were, and what the material was. It seems just a little too convenient somehow....

webair 02-04-2002 04:04 PM

To put all this to rest I just received word that his site is up with another host serving the same stolen content! This exerpt is from the webmaster whose content they were using illegally:

We will be posting shortly, and have contacted other webmasters that we know

As I see this: They could just send him hes backup, so he could use another host.

ZapMan 02-05-2002 06:50 AM

This is very long and very interesting!

traffic101, if you stole content admit it.

Webair I don't believe that you did anything wrong if traffic101 was placing stolen content on his account. If somebody stole my content I would file lawsuite on everybody, the perpatrator and the company hosting the content. You had every right to remove his account. On the other hand if he called your support line and they jerked him around for a couple days, and I belive your company might have, then you were seriosly in the wrong. No person no matter how screwed they are should have to be treated like that. Explain your side to the other person from the beginning. For god's sake if he was a customer for over two years he should have been like gold.

Traffic101, you should backup all files at least twice in places that only the end of the world could destroy.

Webair, as for the free moth of hosting I am sure I could easily do 1k gigs in a month so if you want to hook me up for a free moth then send me some mail

the exerpt above would have more credibility with a name attached to it.
if this "traffic101" dude stole content, lets string him up. If not, you've got some explaining to do. I'm sure that *NO* content provider would mind you attaching their name to their email when dealing with guys ripping them off.

so how about you *REALLY* putting this to rest? :xomunch

waste 02-05-2002 08:21 AM

as i see it, did webair ever ask for a copy of his liscence to use those images? or did they just cut the cord and jerk him around about it. I've been talking to this guy "traffic101" for awhile infact linkdatabase was one of my best trades, i don't think he's the type of person to steal content.

so the question remains did webair ask for proof and he just didn't have it or did they not ask and just took him down without telling him why.

kmanrox 02-05-2002 08:29 AM

as I see it, the fuckin guys a content thief living off of other people's hard work and he should burn...

As I see it WebAir is a top of the line host, and has been for years... IS there really an issue here? lol

I see a lot of host resellers trying to dog on their competition which in my book, is low clas...

But hey, that's just *my* :2 cents: Who am I? Just some newbie....

Ludedude 02-05-2002 08:29 AM

Come on Webair, we're waiting. Or do you guys just pull the cord without proof or due process?

I wouldn't host with someone who cuts the string on a valued client (come on...how many of you guys have been with a host for 2 years???) without asking for proof.

This isn't the first time I've heard shit about Webair.

webair 02-05-2002 08:43 AM

Common guys do you think we would just cut the cord? please! we host alot of clients, don't you think you would have seen many more complaints previously? Anyhow I personally regret the position linkdatabase put themselves in, we did contact them and we received no reply, and for teh record the entire site was stolen! read below:

Original complaint:

WebAir Webmaster - Your customer(japanbukkake.com) below has literally
copied our entire web site word for word, buttons, text, and all content
to "his" site that WebAir is hosting (japanbukkake.com), since this is
illegally obtained stolen material being hosted by your servers, we
thought you should also be notified.... We have already sent this
notification to "[email protected]", and have not received a
response.
ALL the .mpg's & rm's that begin with "bb" in the member's "movies"
directory, have been stolen from our site, we have proof of this as our
name is still imbedded in the files, we hope that WebAir does not side
with thieves such as this, and can help us resolve this.
Please forward this, or e-mail us back with the proper address, if this
e-mail is in the wrong department...
The following message was sent 24hrs.ago to your customer...

japanbukkake.com Webmaster,

Please immediately remove ALL material that you have downloaded from our
web site bukkake-bath.com, and are "re-selling" on your web site
japanbukkake.com

We take this matter very seriously and have contacted our international
attorney's, as well as reporting this to your hosting company, WebAir.

Why do webmasters such as yourself, think stealing other web site's hard
earned work and then re-selling it as "your own" is proper business??
You have copy and pasted EXACTLY from our site, THE ENTIRE MEMBERS AREA,
MENU TEXT AND ALL!!!

Upon verification we attempted to contact the webmaster:

falsified phone number
falsified whois phone number

to add to the pile of shit we have been dealing with we received this yesterday from the original complainant:

"This guy's really asking for it, now he actually is back up & running with this new company...

But hey, that's just *my* :2 cents: Who am I? Just some newbie....

there is still the question of wether or not he is a content thief , he says he has proof, not saying it's for the images in question (we still don't know what they are and who is saying the own them).

Webair may be a good host i'm not doubting that, but thier business ethics are being questioned. i think they have the right to stand up for themselves and rightfully should try to protect themselves. but there does seem to be an issue here the guy lost all of his work and wants some answers (not to mention his backup) he should have the right to atleast the answers.

I am not "trying to dog" an competition, I don't even work fulltime for quik-host, I'm just helping oscer out with sales and some tech support.
I didn't say anything bad about webair, i really didn't even have any knowledge of them until you refered someone to them on another thread.
Regardless i still think this thread is interesting and as an adult webmaster i would like to know whats going on when there are problems poping up in the industry.

waste 02-05-2002 08:56 AM

guess it took me too long to reply :)

seems justified, aslong as they asked and he didn't respond.

now traffic101 you have some explaining to do.

Ludedude 02-05-2002 09:02 AM

ROFL!! Fair enough, I'm done.

A big :thumbsup to Webair for airing their side of the story.

webair 02-05-2002 09:10 AM

"there is still the question of wether or not he is a content thief , he says he has proof, not saying it's for the images in question (we still don't know what they are and who is saying the own them). "

He never sent us anything to show the photos on the site were licensed. The complainant did. WE HAVE A BACKUP OF HIS SITES AND HE IS WELCOME TO IT! The client simply did not reply to our repeated requests for proof of ownership, until the sites were suspended. Again, we verified that the complainant's accusations were indeed true, and linkdatabase.com failed to show us, or even reply to us when we asked repeatedly for proof of ownership.

Attempted points of contact:

falsified phone information
falsified whois phone information
attempted e-mail contac

Webair may be a good host i'm not doubting that, but thier business ethics are being questioned. i think they have the right to stand up for themselves and rightfully should try to protect themselves. but there does seem to be an issue here the guy lost all of his work and wants some answers (not to mention his backup) he should have the right to atleast the answers.

WE HAVE A BACK UP AND HE IS WELCOME TO IT!

Webair would never cut a client A VALUED CLIENT AT THAT, unless the circumstances were overwhelmingly against him. Oliver Rodela left us no choice by serving stolen content. If the content was not stolen, he should have faxed, e-mail, called something in to verify proof of ownership. If he could fax that in today I'd give him free hosting for life =) I believe if he rightfully purchased the content we would not be having this conversation.

As do I, I am a webmaster myself, and we started Webair because we had so many problems with other hosts! We gave him every chance to provide proof of ownership, I'll give him another chance...fax the licensing info to 516.568.0867 e-mail [email protected] call 1.866.WEBAIR1 show me something! It's a shame that he has stolen content, an entire site mind you, brought to our attention of the rightful owner, and we are being hammered for it!
