Didn't the brief 2257 injunction end today, August 1st? Any news on this? Info?

No, I believe it ends in September, but the hearings are today or tomorrow.

August 8th is the next court date, then it's 30 days after any decision is made.

An injunction hearing is scheduled for August 8 and August 9, and the deal applies only to those who are members of the FSC by 2 p.m. Pacific time on June 25.

This was posted on another board and i thought I might share it.
Friends, As many of you know, today was to be the first day of the 2257 Injunction Hearings in Denver. The plan was for some testimony and other detail work today, with oral arguments before the judge on Tuesday the 2nd. Late Friday afternoon -- VERY late -- the DOJ and the lawyers for FSC agreed to a series of "Facts, Admissions and Stipulations". This is basicaly a legally binding document presented to the court with both sides agreeing to certain things. It is done to save time in front of the judge and get little stuff out of the way so the main battle can begin. With that filed late Friday there was no need for today's court session. Oral arguments will start at 9:00am on Tuesday in the Federal Court in Denver. The FSC lawyers are here and ready and working as I type. I'll be there and I'll post from the local Kinko's (two blocks from the Court) as soon as they take a break in the morning. Plese remember that this IS NOT the trial to decide if 2257 is legal overall by itself or if the new regs are legal. This is the hearing to determine if the law should be put on hold until such time as there is a full trial -- which could be a year down the road. Also, it is VERY IMPORTANT to note that if the judge extends the current order and places an injunction (hold) on the law it will only affect the named plaintiff's. Mike Gross, one of the FSC lawyers, has made a motion to extend the order to cover all those within the FSC by the end of business on 08/02/05. If the judge rules in our favor he'll likely grant this motion too. If you didn't get your ass in gear and join FSC before the last deadline in June, you should jump over and do so today so that you are covered until the final trial and appeals in the future. Jimmy |
