Thanks for your input, but why do you recommend them? Have you been required to sign a contract that in essence makes you the 2257 custodian for THEIR content???

3piece chicken Dinner 07-31-2005 09:48 PM

Of course not, they sell gallery spots.

do a search on NaughtyAmerica I'm sure there is a thread or two that will tell you what you want to know.

clearly the concept of 'secondary producer' is lost on you. peace be with you.

sicone 07-31-2005 10:17 PM

Before you wroory about promoing companies, may I suggest you contact a lawyer and find out just what this 'new 2257 law' is and what it means. Based on your post, its clear that you are clueless and have a short future in this business

basschick 07-31-2005 10:23 PM

sweetginger - the new 2257 regs require all us webmaster (secondary producers) to act as custodians of records. so the problem isn't naughty america - the problem is you should go talk to a lawyer or at least go read the law... it's been in effect since june 23. you are risking years in jail by not knowing.

The Ghost 07-31-2005 10:44 PM

SweetGinger.... I can't believe you've averaged less than 2 posts per year, before this posting binge of 3. That is to be commended.

Just curious why it is necessary to try and make me feel stupid for asking my question, rather than answering it? it you can't answer it in a helpful manner...don't answer it...there are no stupid questions, but many answers can be very stupid if made to make the asker look stupid...ok? thank you

Have read 18 USC 2257 and as is with all federal laws, it is vague and find it defies WHOLE interpretation because it is full of HOLES...so I ask....your point is......well besides trying like many others to make me look stupid....what??? would you ask a podiatrist to perform brain surgery on you? no...just like you wouldn't ask a divorce attorney to defend you on a capital crime...this area of the law is not my specialty, so I made the mistake of asking a question about what I should do in terms of this issue of what I thought was a forum of much more experienced webmasters rather than experienced smartasses (someone else asked why I've posted a total of 2 times a year since I joined...this is why and I forgot how helpful you all are generally...NOT)...for my trouble of seeking answers from experience I've been called a guy, my use of a font size was pointed out, repeatedly had it implied I am stupid and there has been a smattering of good advise...so thanks for your input...anything helpful maybe???

Lots of companies have taken quite a few steps to further protect themselves in light of the new 2257 regs. NA has taken it a step farther asking you to sign off and in essence indemnify them. Whether that would hold up in a court of law remains to be seen but if you want to promote them using their content you have to play by their rules. Would I do it? Well, since I show no actual pictures and just wanted text links to galleries I figured I'd pass. The old text links are still up and I get credit for them but I guess I can't have access to the new stuff. As they expire and fade away I'll rely on my base of other sites to promote. NA converts well but I don't like jumping through hoops to get what I want - much like you don't I suspect. Push some other sites like www.perfectgonzo.com, www.epiccash.com or www.rookiebabe.com. They all do well for me.

You should really spend some time getting familiar with this law if you're going to be in this business.
Saying it isn't your specialty is a cop-out. You wouldn't run a restuarant without being familiar with your local health codes, and you shouldn't run an adult business without being well versed in 2257.

Naughty America doesn't want to do business with anyone that isn't following the law. So if you're going to promote their sites using their content then you need to sign a contract stating that you will fulfill your obligation to maintain records as a secondary producer, and then follow through with that.

If you don't like it, don't promote them, simple as that.

:2 cents:

Worst case scenario you got another link to your program out of me. :thumbsup

You've done law school and yet you come to GFY for what amounts to be a legal interpretation?

Now I really have heard everything!

And no one was rude to you - you are just too full of your own unimportance.

? that was a perfectly reasonable reply. You come to gfy asking for info but don't want that info to be told to ask someone that actually knows what they're doing?

well lenny, guess you missed the podiatrist performing brain surgery analogy and my NOT knowing is not a cop out, but a reality,,,many very well versed attornies in their own specialties DO NOT even attempt to know how to interpret federal law...I have so far, working with mark at NA revised all pages with their content to contain nonsexual type content and/or text links and now this contract thing has come up which is also fairly vague, but states "of a sexual nature" refering to promotional content...someone else said the thing about jumping through hoops...if I was not already using nonexplicit type content to promote and link to their sercers, I could understand it and I am wondering if there are others that are being asked to sign contracts and whatnot that are not using sexually explicit content...I am not on a PO'd bitch rant and rave here...I am again trying to get help and info from more experienced webmasters...granted you gave me some good input once you got thru your seemingly minor putdown...so thanks for that...I don't think if I stopped you on the street and asked directions you would say you must be f'ing stupid for not knowing where that is...then ahain...maybe you would...thanks for the eventual input either way...I guess since you once worked at NA, you might know what you're talking about...then again...maybe not...LOL

If you don't know it's because you haven't consulted an attorney who specializes in our industry.
That's your fault and it is a cop out.

Coming to this message board for legal advice certainly doesn't make you look very intelligent.

Bottom line is hire an attorney, have them review contracts before you sign them. If you can't afford an attorney, find a new hobby.
I hear stamp collecting is becoming popular again.

RyuLion 08-01-2005 01:09 AM

I've promoted them in the past.
I'm sure they'll gladly answer your questions.

Can guess who went to a podiatrist for that brain surgery...and to think I thanked him for his advice...bet you collect these lenny or at least get a lot of them...>>> :321GFY
