What in the FUCK is wrong with Cops in America?
 
Couple cleared of child sex charges
(July 27) Two North Carolina parents who were charged with child abuse over a photo that showed the father kissing his naked 16-month-old child on the belly button have been exonerated and reunited with their children. Charbel Hamaty spent six months in prison before the charges of sexual assault were dropped.

It's not one cop who got up one morning and decided "hey, I'm going to arrest this guy". It's some bureaucrat who decided to freak out first and ask questions later who ordered the cops to go arrest the guy.

Come on man don't blame the officers, they were only doing a job. Complain about the photo processort who jumped the gun on the pictures, or the State which created the law with little to no lattitude on discretion byt the cops, or the prosecutor who actually took the case to court, or the Judge who couldn't see through the bullshit (or jury)..

But for Chrsit's sake don't just blame cops for shit like this. If you are going to blame one group blame them all and fight for some changes at the level that makes a difference, not the last line.

The cops can refuse to make the arrest, on the grounds that the image does not meat the legal requirments for sexual assault.

That's not always true. I don't know of any state that lets a police officer have that kind of discretion on implied or accused assaults on minors. That is up to a prosecutor or judge and jury, to say nothing of departmental policy on such matters.

Note: We haven't seen the picture in question, nor do we know the family history of those involved. Was the father a convicted sex offender? Was the mother? So many variables we don't know that would allow any of us to make that call (wether or not the cops did the right thing).

It would be one thing if it was shoplifting or running a red light. But can you imagine the consequences of a police officer refusing to arrest someone suspected of child molestation? A cop is just as concerned about losing his job as the next guy and it's understandable that he will follow an order.

In every state that I know of, the officer can refuse to make the arrest. In fact when there is any question, they will usually call the State attorneys office and run it by them, and even then the officer has the right to refuse. He can make the appropriate reports and pass it up the chain of command. I have seen that done many times.

You're not taking into account this being an alleged crime against a child.

In most states you have mandatory reporting laws when teachers, doctors etc think there is some kind of abuse involved which doesn't give them any discretion..they have to report it, follow through with it or they become liable whether it's criminal or civil.

I am not an American, but spent some time there. You are right, they exaggerate things for no real reason. It might result in parents being threatend by their own kids. :disgust

The reason is that the recent news kinda whitewashed the whole incident - he wasnt kissing him on the belly button - he was kissing his penis
However - that said - that is a normal affection family practice in Lebanon where this family was from.

so after the cops arrested him..who put him in jail for 6 months.....?

Here the cops can only hold u a few days........... a magistrate or judge then decides if theirs a case to answer...quite often they release people right away.
