CDA Act upheld because of "insufficient evidence"
 
A panel of Federal Judges upheld the Communications Decency Act over objections from the NCSF and their plaintiff because they had submitted "insufficient evidence" to prove that it was unfair to apply a geographical test for obscenity to the Internet. One wonders exactly what "evidence" the court would need, in light of the fact that, based on the logic of this law, the laws of the most restrictive community in the US would govern what everyone else can legally see. Moreover, since a defense under the Act is to require the use of a credit card to see content, there will likely be much less free content in the future if this ruling is upheld. For anyone wanting more info, here is a discussion of the law on the NCSF website. Hopefully, the appellate courts will find the logic of the Extreme Associates decision more compelling than the three judge panel in this case did.
