AVN.com Article: CashLikeWhoa Wins Big Legal Case Against West Coast Productions!!!
 
Many GFYers have shown tremendous support and emailed us asking about the status of our legal case against a big L.A. video company - West Coast Productions - that infringed on one of our site names - AssLikeWhoa.com.

I want to give you an update to let everyone know how this was resolved.

The short version: "WE WON BIG!" :thumbsup Chalk one up for the little guys!

under a legal agreement:

1. West Coast Productions has to pay us for infringing on our ALW name.

2. They have to pay all of our legal costs and fees.

3. They have to pay to RECALL the thousands of their ALW videos that have already reached stores and online outlets.

4. They have to shut down their video line because the name they chose was almost identical to ours.

I really appreciate the support that we got from a lot of GFYers as we fought the legal battle to protect our trademark and to protect our turf. :thumbsup

Big companies like that usually dominate small companies like ours on stuff like this. But we fought like hell to protect our shit and we were ready to go the distance for a long legal fight.

About our name choice, we have heard that before, and I understand why some would think that.

But we have nothing to do with the now-dead LikeWhoa hosting at all.

They are gone.

We are here.

That was then and this is now.

And we hope to be here doing good business for years to come! :thumbsup

Really. I would have just cut some sort of deal with them using the legal issue as leverage.

My guess is they will promptly declare bankruptcy now and disappear.

this may be a really stupid question but why would you not turn this to your advantage (like rectalrooter.com) and get a internet licience to the series, and an ad spot on the dvd, video to drive traffic to your site.

True. And that is what makes this legal victory so sweet and so complete.

We were financially prepared to fight them all the way on this.

We had the financial firepower to hire one of the best law firms in America to be on our team.

Backing down to them was not an option. We were prepared to throw a ton of money at this because we felt so strongly about it.

Giving in to them was something we never considered.

Congrats on your victory! I see where some are coming from regarding using it to your advantage IE type-in etc., however, you felt strongly enough to protect your trademark and won the fight. Good on you! Maybe next time someone decides to mess with the "little" guys business or trademark they will think twice!

Interesting. I hope the settlement truly worked out in your favor. But that all depends on the amount of cash involved in the settlement it's self. Hope it was huge.

You might have been able to parlay your branding and advertising into the entire line of WCP products, which i'm sure is of excess of 20,000+ DVD sales a month and an additional 1000's of rentals and arcade views, directed at your customer demographic base.

But you did what you guys thought was in the best interest for your company and brand, so kudos for you. :)

But anyone familiar with the ebony niche, big booty niche, or ethnic niche, knows that we have been leaders in those niches for years and making serious money. Our affiliates - we love them - know that we are making them money.

Long before West Coast Productions tried this, we were not hurting for money. :1orglaugh

So we never saw this legal thing with them as a "meal ticket" or chance to get some extra type-in traffic.

We saw them as predators.

We did not need their money. We needed their hands off our brand so we could continue making our own money with an established brand and name that we have spent years building and promoting and making into a household name in our niche.
