I need some help from Ebay experts. Now.
 
Hi guys,

I have shipped the item to the following person almost a month ago and he says he never received the item. Here is the latest e-mail from that guy :

"I have not received the item yet and as of last Friday I have
launched an investigation on my own behalf. Being as I am an Attorney
licensed in the state of Florida and Michigan I have the free resources
needed to launch such an investigation in the United States. Also, as
stated to you before, I am on the board of directors of a diamond
mining company in Canada and have asked one of the members of the board
who lives in Canada to help me by launching his own investigation over
there which he has agreed to do. If the package was lost in the mail
between our two points I will find it. If the package has been returned
to you please notify me at once so we can set up a second delivery
attempt. If the package has been returned to you I would like you to
send it by Fed-Ex and get a tracking number that you can email to me.

Also, I have not come to the conclusion that you never sent the
package but if that is what the end of my investigation shows, then I
will have no choice but to treat it as a crime committed on ebay and
will first ask you to refund the money to me to stop all that I am doing
in regards to this matter. Again, I have not come to that conclusion
yet but as a month has passed since this auction has ended, I plan on
resolving this one way or another.

Please understand my position in this matter as I am an ebay
member that wishes to remain a satisfied member and also help to keep it
an honest way to shop for goods. Please email me back and let me know
if the item has been shipped back to you or not.

I think that guy received the item and is trying to accuse me of not sending the item. What should I do? I called Canada post and they told me it's been shipped.

This is the e-mail I replied today :

"Steve,

The item has not been shipped back to me.

I understand the situation, but accusing me, or even pretending accusations
on my part isn't going to help this situation.

Give me the phone number of your diamond company. I would like to talk to
the person you assigned over there.

Since you are an attorney, I would like the phone number of your office in
Florida.

As soon as I have information, I will let you know.

I sent the scanner on june 23. What are my other alternatives?

No alternatives that I know of. If you are a 5year 96% feedback member his one bad one is not going to hurt you.

As far as the atty stuff. He is bluffing. If nothing else the court filing fees would cost more than a scanner.

Ebay buyers are complete pricks and will rob you blind at every corner or bitch when that isn't an option. If you sell much on there you will run across many assholes just like this one. (I've also seen 100% fake threats of being lawyers etc.) Do you have any sort of tracking on it or proof it was shipped? He's an idiot for thinking he can just find a lost package as well.

That's the thing. No tracking number was available to the United States when I used CanadaPost. I used ExpressPost but there isn't a tracking number available to the United States (only in Canada). I should've used Fedex or even UPS. But in 5 years, that's the 1st time I have this problem.

Who would you contact regarding a lost shipment, the insurance company? What would they do about it? How would they go about determining if it is indeed lost or not?

This guy is a scammer. Did you post prior to purchase how you would ship?

I bet this person is a full-time scammer. I bet he / she realizes that you do not have a tracking number.

Email him back and tell him that the service you used is going to run a "trace package." Explain that this is a final alternative and full proof.

He might be true to his word, but I would say that he is a scammer and I would say I am right a lot.

When you do sell and ship stuff on ebay always get a tracking number. Everytime i have sent something without a shipping number i get screwed by a dumb ass like this. If he paid by credit card you have to sadly refund his money as he will do a chargeback. If he paid by money order screw him keep the money.

Assuming express post is the same as 2-3day here there should be record of it being "scanned" at points along the delivery route.
If you can get confirmation of the package being checked/scanned anywhere along the line that would show that you indeed shipped it.

You need to get in touch with the insurance provider and ask them what you need to do as the recipient has not received the package and try and collect on the insurance. If he paid via PayPal he will get his money back unless it has been more than 30 days and then you may luck out but PayPal can still choose to refund him. If he left you neg feedback and you want to get it removed he has to agree. Offer him a refund if he provides you with a statement saying that he never received the item and if he agrees to remove the neg feedback. Process the refund after you get both of these accomplished. It is a bum deal but without tracking there is not much else you can do. I also expect that the insurance company will not refund the value of your item as it did not have tracking. Basically they should not have sold you insurance on the package as it wasn't insurable without tracking. Sorry, but thats the way it goes.

Yes because that way you can PROVE you sent it. People think online auction scams involve people posting fake auctions when most of the time it's people buying stuff from auctions and not paying.

Also if you send by the postal service go ahead and add insurance. Put it in your listing that it's mandatory. That way if some fucker claims the item is broken they'll have to deal with the USPS.

That's another problem. I moved in my new house 3 weeks ago. I don't know where the stupid CanadaPost receipt is. :Oh crap

It was just a simple receipt without a tracking number. But I am sure that could've helped. I think I'll need to call Canada post again.

Email him back and let him know you are so happy he has the 'free resources' to investigate this as you would also like to know what happened to it.

Most he can do is dispute through EBay/Paypal and even then you, as the seller, have a chance to give your side of the story.

Sounds like the asshole is some kid looking for free shit, dont sweat it

I think if I ever did any serious ebay selling, I'd try to do "adult signature required" on everything, and pass the costs along to the buyer. Not sure what else one can do to prevent this sort of thing.

Well, I am still waiting for his reply. I asked for the phone number to his diamond company and his office in Florida.

Well, I should've used a service with a tracking number. I get one if it's shipped inside Canada. But in the U.S, I had to upgrade it with Purolator. My mistake.

He is not listed at http://www.sedi.ca so I highly doubt he's on the board of a diamond mining company. Not many people privately finance diamond exploration when you can use other people's money. My :2 cents:

Sounds like a fake to me. I had a similar probleme but the fucker didn't know I had a tracking number for that package. But that guy tried to rip off all the sellers he bought from. Two weeks later his acc was closed

exactly thats the first thing id check. Sounds like shit to me, he probably just got it. I had to proof that once too, luckely the mailman remembered delivering it...
