Local governments can seize your home at will

I'm sure most of you know it can be done, but it's real bull shit. Talk about the land of the free... the government is free to do whatever they want.

"Local officials know how best to help cities".... riiight.

Giorgio_Xo 06-23-2005 08:31 AM

That's why we have a 2nd Amendment... to protect the other ones. People need to rise up to defend what is right.

nojob 06-23-2005 08:31 AM

Got to love america. Imagine having to get ride of your childhood home to make way for a mall.

Even I'm starting to hate it.

tranza 06-23-2005 08:35 AM

That's fucked up...

eroswebmaster 06-23-2005 08:37 AM

haha how do you guys think George W. Bush was able to get a new stadium built for the Texas Rangers?
Do a search on that and Arlington, Texas...and I still can't believe so many fellow Texans voted for this dumb ass.

FilthyRob 06-23-2005 08:37 AM

"Any property may now be taken for the benefit of another private party, but the fallout from this decision will not be random," O'Connor wrote. "The beneficiaries are likely to be those citizens with disproportionate influence and power in the political process, including large corporations and development firms."

That's fucked up.

infecto 06-23-2005 08:40 AM

What kind of payment do you get for it?

BRISK 06-23-2005 08:40 AM

Good news for Wal-Mart. Now they can tear down all those pesky homes and build a megamart in every town.

Wheeeeeeeeee!

Don't they already have one for the Texas Rangers? I think they're building one for the Dallas Cowboys now.

Libertine 06-23-2005 08:41 AM

Sounds like communism to me, because if it's allowed with land, why not with businesses, resources, patents, copyrights, labor, etc?

Fair market value. This is happening here too in Dallas for the new stadium for the Dallas Cowboys.

Yep. This is just the beginning.

BRISK 06-23-2005 08:47 AM

You might want to burn a flag as a political expression to protest this situation, but that right will be taken away from you soon as well

Yes and the one that was built for the Ranges was built when George was one of the owners and they screwed local homeowners out of land for additional parking.

AmateurFlix 06-23-2005 08:51 AM

Looks like there's only one hope left for getting this country back to the ideals it was founded on:

Matt 26z 06-23-2005 08:51 AM

Just another law funded by corporate America.

Now they don't have to pay property owners more than what their home is worth. Sometimes those people hold out for a long time to get more from the developer. Now the developer just has to go crying to the local government and they get their way.

thats bull. most of the time cities go by assessments made by county assessors. depending on your area, this might be done only once every 15 years which means if your house is currently valued at 400k with the recent real estate boom you might only get 200k because your property is on record as being worth this amount. of course you can fight it but that would require $800-1000 for a private appraisal plus lawyer fees which arent an option for many. the city fucks you out of money then gives you a "discounted" property tax on a new property you buy.

mardigras 06-23-2005 08:56 AM

This might actually work out OK for me, when the bastards in my area wanted more tax money they suddenly tripled the assesed value of my home. I'd be more than happy to give it to them for the amount they have been taxing me on, I certainly couldn't sell it to an individual for that :upsidedow

Maybe where you live, but "fair market value" is used here in Texas.

The same people forcing you to sell, ofcourse :thumbsup

It's the perfect business model... find something you want to have, force the owner to sell it to you at the price you want to pay, profit.

jollyperv 06-23-2005 09:54 AM

Hell yeah, now maybe the government will come seize all these shitty new crackerbox condos that spring up everywhere.

fair market value might be to the extent of the city calling a realtor and asking for a price comparison for recently sold properties in the area with similar features. the problem is they determine which realtor and often shop around for the lowest possible price. your best interests arent in their mind when they are seizing your property and you will always get screwed in the end. people hear "fair market value" and think "wow, ill get what i'd probably make if i sold my house tommorro using a realtor".

Holy fuck... I really thought that ruling would go the other way. Eminent domain in the NE... if I remember correctly.

Guess the liberal court doesn't care about property rights...

What liberal court? Things have been falling on the conservative side lately, usually by 1 vote. Once Bush can get a SC judge appointee we will all be officially invited to go fuck ourselves...

John Paul Stevens, Anthony Kennedy, David H. Souter, Ruth Bader Ginsburg and Stephen G. Breyer all decided your land isn't your land... it's the governments.

You should like it, too.
