I need out of my candid hosting contract... help!
 
I signed a one year contract on 4 servers last October. My main server goes down every 2 months or so. They did not have it monitored so the outages were very long. Lasting hours and up to a day. Last month when it went down. I offered them 2 months of their fee to let me move. They assured me I was now monitored and it would be fine. Yesterday, I was down for 10 hours. I saw it and emailed them and after an hour they restarted the server and it came back. They claim it is monitored but checking every ten hours or so does not seem right. If I had not caught it how long would I have been down?

I have 4 months to go. they say they will accept 3 months of fees to let me go. Does that seem reasonable? They are not meeting their end of the deal.

Techie Media is all set to move my stuff to its new home.

PS my sig is because I was pissed yesterday.

Read your contract. It doesn't seem like they're living up to their end of the deal. There should be an out clause in there for this kind of situation

10 hrs isnt monitoring I know our server is down theyll get a notification in like 5 mins plus weve got websitepulse set up.

I couldnt live with 10 hrs

We were with them for a bit and boy we were sorry. Mike from Webair hook us up and we have been there and happy for 4 years now. I used to tell people Candid sucked but the people who work there would ICQ me and be nasty about it.

I got pretty fucked by Candid myself, but that was over 2 years ago and I heard they had new ownership?

Either way, I will never be going back to them. I'm with realitychecknetwork now and it truly WAS a reality check after being with candid for so long.

As for your contract ... first off I'd ask them if you will be refunded for all of the downtime over the last year. Not for loss of profit, simply for the time you were paying them and your server was not up.

If they don't at least seem to 'feel bad' about your situation and try to make it right, tell them to fuck off.

You're proteced under consumer laws, you don't need to offer them anything. You have the right to cancel the contract, it's actually been technically voided already by them not providing a satsifactory product/service under the length of the contract. I don't understand, you want to pay them because they are having problems with your server? Seriously, I would have demanded a free month already, yet you want to pay them....very odd

I want out they said I had a 75% buyout so I countered with 2 months thinking it was easier to get on with life. Now I think screw it. Document everything and if we get court, see what happens.

they now claim because 15 people an hour instead of the normal 1500 could get to the server it was not their issue.

Fuck them....let them sue you, then you countersue for business disruption caused by their incompetence.

I doubt they'll even bother suing, but it they do and you show them you're serious about fighting back they'll probably go away.

We've been with candid for about 2 years, some slight outage problem once, but nothing that couldn't happen wherever you host - and the tech support people have been helpful and competent.

Still, in your situation I would say you don't have to worry about anything. Just stop paying and move to the new host. As has already been pointed out, there are many stikes against there acutally collecting from you.

read the contract, look at what it says about their commitment... if they guarantee a certain % of uptime and they do not live up to this they're breaking the contract. You shouldn't even have to pay them to leave lol.

I also find it strange you signed a contract for hosting, this isn't the stone age.

There current stance is that is was up stream of them. The problem effected every site on my one server. Not any of my other 3 servers. They did not have a known issue up stream. They admit they did "some things" to the server and after that is allowed me to access the site. But they did not reboot as they claimed earlier. So there was no "downtime". 15 people an hour leaked into the site and that is all I can expect with Candid hosting. They do not feel a need to guarentee more then that. Quoting them, "traffic goes up and down and we do not control that".

If I was you. I would have went month to month or quarter to quarter. Especially if your exit fees are going to equal the cost saving proposed by the year contract.

Next, I wouldn't pay them another dime and would just leave. I am sure there is a quality of service clause somewhere in the contract. If not, check with your local state laws governing contracts and see if there is one pertaining to the legality in question.

all of my webair sites got hacked, i was promised things would be back to normal the next day.. but they werent.. a week later, still nothing.. after that they just started ignoring me and left things broken

i use www.mjzhosting.net now.. they take paypal, are cheap, and have great uptime/customer service

So am I the only one who doesnt get the contract part? Why sign a contract for so many months if all the good hosting companies work on a monthly basis built on happy customers instead of narrowing clients down to a contract...

If you have kept record of all the problems, downtime and communication with them I would say it is safe to stop paying and just move your stuff over. They have not delivered their end of the deal and since they aren't accepting this enormously generous offer from you they would have little succes in court... but I'm doubting it's even worthy of legal action.

My advice: fuck them, stop paying and get a solid host (Isprime or NatNet!)

I had one of my worsest hosting experiences ever with Candid. I can only say stay away from them. Had a server that was down for more than 20 hours without having any problem at all. I tried to have the tech get the server up again but he needed to wait for a senior tech first. The senior tech had of course more important things to do like breakfast lunch and stuff. At the end the server was down for more than 20 hours without having any problem, the tech took it down because he used a bad terminal emulation to connect and got some garbage output on the screen.

They also did not want to let me go, well i did not care :)

Candid sucks.. We had issues with them at one point. Just move your shit and walk away.. nothing they can do about it anyway unless you live in the same state, at that still nothing they will do about it.

All of you asking about why a contract. No idea. Hosting is not a huge part of what I do. Looking at all the bullshit, it has become more important by a ton.
