Dear affiliates,

It took us a while, but after careful review and extensive legal advice with three of the top adult entertainment law firms, (who are extremely familiar with 18 U.S.C. § 2257 in their capacities as First Amendment and Criminal defense practitioners) we have come to the following determination, summarized by Jeffrey Douglas, one of our attorneys:

"...Despite General Gonzalez? efforts at reviving the concept of ?secondary producers? in the most recent version of regulations in support of 18 U.S.C. § 2257, the concept is not supported by the statute itself. The only case addressing the issue, Sundance Assocs. Inc. v. Reno, 139 F.3d 804, 807 (10th Cir.1998), held that the ?secondary producer? requirements of the regulations to be unconstitutional. We rely on that holding, and further decline to violate the privacy of the performing artists by disseminating private data when not required to do so by law...".

What does this mean?

At this time, with the law in it's current form, we will NOT provide affiliates with the model's identification or releases.
PanchoDog Affiliates are in no way shape or form, required to keep, maintain, view, or otherwise possess any documentation that pertains to the 2257 regs.

What changes then can we expect from PanchoDog, regarding the 2257 regs and are you compliant?

Panchodog, all it's holdings, affiliate companies, and partners are fully compliant with the 2257 regs.

You may use our hosted galleries, movies, FPA's, and other hosted material, which provide a 2257 link at the bottom of each page.

If you are using downloadable material, i.e. zipped galleries, images, movies, etc... where the html page is made/designed/hosted by you, then we suggest you add the proper link to our 2257 page, located on each website, at the bottom of each page.

Can we promote your sites, that contain sexually explicit content?
Yes. However, you MUST place our 2257 link at the bottom of your pages, website or promotional material you are using if it is NOT hosted by us.

Well that's a relief

It's interesting how all the different lawyers are interpreting the law. There are so many variations of what the lawyers are saying. It's going to be interesting to see how this plays out in court.
