"Secondary Producers"

Does anyone know what constututes a "secondary producer"?

Could this mean an end to blog providers such as LiveJournal, because they can't control all public content on their servers?

What about hotmail or yahoo? Can they be held accountable for pornographic attachments uploaded to their servers?

What does 2257 mean for Gofuckyourself?
If someone posts hardcore pictures on the boards without 2257 records and the feds see it, can they shut down GFY?

(4) Producer does not include persons whose activities relating to the visual depiction of actual sexually explicit conduct are limited to the following:

(i) Photo or film processing, including digitization of previously existing visual depictions, as part of a commercial enterprise, with no other commercial interest in the sexually explicit material, printing, and video duplicators;

(ii) Mere distribution;

(iii) Any activity, other than those activities identified in paragraphs (c) (1) and (2) of this section, that does not involve the hiring, ontracting for, managing, or otherwise arranging for the participation of the depicted performers;

(iv) A provider of web-hosting services who does not, and reasonably cannot, manage the sexually explicit content of the computer site or service; or

(v) A provider of an electronic communication service or remote computing service who does not, and reasonably cannot, manage the sexually explicit content of the computer site or service.

Look at iv and v.

here is your non-legalese brief:

"you will spend time in prison being forced to go down on a fat black woman named "big edna" while being sodomized at random by competing gangs of woman everyday for 2 years or your life because you are too stupid to sit down and read a few simple paragraphs - but instead relied on uninformed people on an adult message board for serious legal help two days before it mattered"

What I gathered from that is that hosts are exempt.
"reasonably cannot, manage"... What does that mean?

Here are some links for you to read.

I suggest you take the time to read them, rather than asking on the board, as this is very important.

Good luck to you.
