Careful what you read though
Usually people get sued not for spamming, but for what theyre selling

Before there was a story on some guy getting sued for $10 million, but if you read the story youd know he was selling fraudulent products

In this case,

the man didnt get sued for sending 74 million a month

that statement with the 74 million was that he was selling servers at $700 a month capable of sending that amount of emails

im sure he sent much much more

but again, dont let the media fool you, this was not so much for spamming as it was for selling servers meant for spamming
