It depends on if in that shoot/set she used the dildo to masturbate. You can't really take the first picture in an explicit set and use it even though the picture is non explicit.

Do not interpret what ccbill allows to what the law allows. CCbill would be and should be just playing it very safe.

Of course you can.... the law applies to each individual photo, not a specific set.
