TotemCash 2257 Annoucement
TotemCash would like to advise all of its affiliates within the United States jurisdiction of some changes that will be taking place with its affiliate program in light of the new 2257 requirements that will become active June 23, 2005.
Although a large part of our content is exempt from 2257 because softcore material is not covered under any 2257 legislation to date, here are the decisions we took to reduce the impact of the new regulations on us and our affiliates.
VirtuaGirl and other softcore products
VirtuaGirl, VirtuaGuy and StripSaver are softcore products. We only had a few banners, pics of the day and sometimes the last images from some galleries that can be deemed ?sexually explicit? and we don?t feel this aspect of the promotional material was vital, considering the products, to attract and convert surfers. We?re updating all our promotional material on TotemCash to either remove sexually explicit material where we feel it was not really needed or clearly state what is sexually explicit and what is not. We ask our affiliates to remove the few sexually explicit images they may have on their websites before June 23, 2005.
OneGirlaDay and other explicit products
OneGirlaDay promotional material features sexually explicit content and falls under the new 2257 legislation. Affiliates must use our promotional content that is not Sexually Explicit and are encouraged to take advantage of our hosted galleries that display sexually explicit content since linking to these pages does not require them to hold records. We?re working on a solution to give affiliates access to our 2257 records in the event of a lawful 2257 investigation. We?ll let you know when that solution is ready.
?Sexually Explicit?, our understanding of the law
Although "actual sexually explicit conduct" isn't defined in the new regulations, the applicable definition is found in the United States Code: "sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex; bestiality; masturbation; sadistic or masochistic abuse; or lascivious exhibition of the genitals or pubic area of any person" (18 U.S.C. 2256).
We appreciate the support of our affiliates in understanding the changes, we plan to continue to be proactive and offer additional solutions to 2257 compliance as they become available to us.
