Dating sites & 2257

Sure once in awhile someone posts their cock...

So whats the deal on that?

Do you fall under service provider?

pr0 06-13-2005 05:33 PM

bumpidy bump bump

how is this going to effect AFF, etc.

tranza 06-13-2005 05:48 PM

Do you use sexualy explicit content to promote them?

NetRodent 06-13-2005 05:54 PM

Most dating sites wouldn't fall under a service provider/common carrier defnition since they review photos prior to posting them.

Varius 06-13-2005 06:02 PM

As far as the sites themselves go, what I heard was they would try to fall under a 'reasonably manageable' clause (by saying it isn't reasonably manageable. I haven't looked too much into it, as it will not affect us in that sense at all, since we have nothing to do with the United States.

As for promo content for affiliates though, I think that likely, sexually explicit content offered to American Webmasters must be replaced by other acceptable content.

Those are just my personal thoughts on the matter though :2 cents:

Do you do business in the US? Do you have US customers? Do you advertise with US based companies? Do you have US affiliates?

The affiliate part is what I mentioned above...that can affect us.

As for advertising, we tend to use ads that are sexy yet not sexually explicit anyways for our campaigns, so that's no issue.

As for having US Customers, I'm not sure how that even applies. A surfer will not be prosecuted for viewing a website under 2257, atleast the way I understand it...

Again, these are just my opinions though, not anything legal or from IwantU :winkwink:

I'd rather your interpretation be accurate but from the preliminary stuff I've been hearing even if you're not physically located in the US, you still should comply if you do business in the US and any of the owners or executives of the company might want to enter the US. Doing business was defined as advertising in the US or having a significant number of US members among other things. Of course this is just my marginally informed opinion, take it with a shaker of salt.

Hrmm that is definately an interesting item....although at worst, if they did manage to enforce that, all it would mean for me is that I couldn't attend the US-based webmaster shows. I never end up going to the US other than for that reason....

I think if our Costa Rica show in November turns out to be a success, you might see a lot of programs and companies start moving down this way :upsidedow
