Songs on porn movie trailers..Is this legal?

Suppose a paysite has a trailer movie with cliff richard music... Is this legal, or can Cliff sue him for that ?

Where did you get the music?

Unless the owner says "you are free to use this music in other productions" then you must pay a license fee.
