Cropping thumbs and 2257 on TGPs.
For those who run tgps. What if all the thumbs used do not show any explicit content, all non nude thumbs or head shots. 2257 not required huh?
|
well after reading the regs that is the conclusion i came to. but when i asked the same question all these gfy armchair lawyers scolded me saying "of course not, you still need the regs because the image comes from a sexually explicit image." sounds like bullshit to me, if you dont have explicit shit on your site then what would you need 2257 for?

yeah that's what I'll be doing :}

there is a speculation that if you use cropped image of a larger picture which has sexual explicity on it, then you need docs for the cropped image as well.
does the thumb convey sexual explicity or not but when the feds are at the door, better to have all they want to see. by no means this is a legal advise. |
my opinion (not legal advice 'cuz I'm a dumbasss) is that when you crop an image, you are creating a "new work". The image you created and are publishing is not covered.
It doesn't matter what the original image contains. You aren't publishing the original image. :2 cents: |

Okay, but how is the person reviewing my site for 2257 going to know wheather there is "another" picture taht i cropped it from and weather or not that picture has explicit content.

Alex!! Dude you are trying every way not to comply. It will be the 23rd and you'll still be looking for a way out. Comply and do not worry anymore. It will be a pain at first but once you have complied you'll sleep better at night. :)
