WARNING to all afilliates who recieve checks from sponsors.

Just got back from 2 diffrent banks and was told it will take 7 days for my sponsor's out of state checks to clear. These checks were from 4 diffrent sponsors. Both banks told me some new law with the patitrot act is being fully infoced now. So if you make a out of state deposit the check will be held for 7 days. So if you are looking foward to having your money the next day it will not be there. Just a heads up for you guys :thumbsup

Phoenix 06-01-2005 08:52 AM

patriot act is holding your money?

lol

run while you still can

FilthyRob 06-01-2005 08:53 AM

I never just cash my checks, but damn that sucks. 99% of my money come from outside California.

Terry 06-01-2005 08:53 AM

Where I am by default all banks will hold US checks for a minimum of 20 days and up to 30 days in some cases. Once the bank knows you they clear it sooner though.
Hope they dont increase it.. Im on my way to the bank now so let's see if they say anything to me.
Thanks for the fyi.

simple simon 06-01-2005 08:53 AM

nothing to do with the patriot act, I think their blowing smoke up your ass. My bank has had a 7 day policy for 10 years I been with them. Any out of state checks :1orglaugh

Pete-KT 06-01-2005 08:53 AM

Thats what both of my banks told me man lol It even put on a hold on for a check from the state of florida. I had to go back and settle that. The tellers didnt know there was a overwrite code. So If you run into a problem cashing a state check talk to a branh manager.

I am down here in florid and my out of state checks cleared the next day. Good luck and let me know how it goes.

mardigras 06-01-2005 08:56 AM

Are you in the bank enough for that teller to recognize you? I always go to the same branch drive-through and 99% of the time it's the same lady. The account is only used for my sponsor checks, so they are always out of state. As soon as I deposit one I can go around to the ATM and check my balance and it's been added.

TheDoc 06-01-2005 08:56 AM

Deposit your money through the ATM it will post the next business day with no problems. Even International checks.

SmokeyTheBear 06-01-2005 08:57 AM

Its just bank policy not patriot act .. I just cashed 1 out of country check and 1 out of state check.. I had to wait 5 minutes.

Just going by what both banks told me. Oh well just givien ever one a heads up.

KRL 06-01-2005 09:00 AM

You better get a stronger relationship with you're bank, cause that's BS.

Hornydog4cooter 06-01-2005 09:00 AM

oh by the way it was Bank of america and Washington mutual.

SmokeyTheBear 06-01-2005 09:00 AM

Tell your bank if they dont smarten up , you will move your banking elsewhere. Tell them you know damn well they can verify the check instantly, also tell them they are violating several laws by lying to you about it.

Mine go str8 in. Banks lean on the Patriot Act all the time. Sometimes they seem to be making up their own rules. They tell employees, it's the law and they believe. Then pass BS down to you. Ya just need to get the facts right on the law and then have a talk with a bank officer.

My go str8 in cause of my relationship with the Bank. They have rights to hold a check per federal law. The amount of time depends on the size of the check. Also you have rights to some of that money right away, again depends on the size of the check.

Now if you have $15 in your account and your deposit is that $35 ccBill check, well.....

This is not legal advice, I am not an attorney.

exactly.. would it make much sense for the patriot act if you couldnt cash your check at a bank but can cash it at a ghetto check cashing place ??

Do you think banks would allow that ?? nope. Its your bank's policy because if they tell you and 5 million other suckers they cant cash their checks for 10 days then they have 10 days to spend your money.

Lets say they have 5 million customers and they all have $100 checks to cash. So they have 500 million dollars to spend for 10 days. They could take that 500 mill and play the currency market with it and make a bundle.

Misrepresenting a law is unethical at best. You might have a real point about the Banks violating laws with lies. Might depend on which state?? Don't know the federal law on the subject. In any case, I don't see a bank arguing with Smokey for long :thumbsup

I have dealt with banks before :) I could go on for hours about bank scams and how to avoid them. I have changed my bank quite a few times..

BofA had me arrested at one point for demanding my cash..

Infact i will tell you a little trick if they ever want to "hold" your checks.

I did something similar before trying to cash a check.. I went in late in the day just before the bank closed to cash a check..So the lady stamps it and then says she cant "cash" it because its to late in the day , and it had to be deposited until tomorrow , then i could get the money out.. I explained that i was going out of town and needed the money right now.. She says "sorry" so i said ok well then just give me the check back and i will cash it at a check cashing place. The lady says " now that i have taken the check i can't give it back " I almost went beserko. Im like "either give me the check or the money , because i am not leaving without one of them.. she proceeded to tell me i wasnt getting either back.. So i said " BANK MANAGER NOW"

Bank manager comes out , and i explained the situation and she says " sorry sir you can't get the money until tomorrow" So i said ok then im closing my account right now..

It turns out they had to give me the cash for the check because they werent allowed to give me my check back nor were they allowed to keep my check if i close my account :) Drastic , but it worked..

Hell all you have to do is tell them you will be doing lots of biz with them and they will drop that shit. At least that's what i did.

MikeVega 06-01-2005 09:26 AM

All my out of state checks always take 7-10 days ...that's nothing new.. :2 cents:

all you need to do is cash it against your savings account ... assuming you have money in your savings account to cover it ..

I'm back.. and no difference here for US checks.

chadglni 06-01-2005 10:39 AM

My bank held my checks one time because they were large and "out of country". 20 explitives and 1 threat to call the cops on my later I had my money and they were never held again.

Chris 06-01-2005 11:40 AM

lol you are a tool if you think that lol

most banks do that if you do not have along positive standing account with them

any check I cash is instantly deposited no matter if it is from a diffrent country or state :)

sometimes a 2 day old on international for currency exchanges

yup. i just found that out this past Sunday cuz Monday was a holiday & i needed a check in my account, so i just deposited it via ATM and it automatically said that my funds from the check (plus whatever i have in there) were available immediatly. :upsidedow

Shooting_Manic 06-01-2005 11:49 AM

All those proves is that you had a ZERO balance at the time you tried to deposit and cash them.

I have out of state and country checks all the time and never one problem. Then again, ive had my current bank for four years and I dont live from paycheck to paycheck.

Deposit it the money, wait the 7 days, let them see that the funds you deposit are always good and you wont have this problem in the future.

God, I wish people took the time to teach me this shit when I was 18. What the fuck do they teach in HIgh School these days? Seems like high schools need a "Basic Living Skills" classes to teach stuff like this.

TheSenator 06-01-2005 11:51 AM

My checks clear in less the 24hrs unless over $10,000.00

adonthenet 06-01-2005 11:54 AM

its always like this.. regular..
10 biz days.

dcortez 06-01-2005 11:59 AM

I just cashed two US cheques on the spot - and I'm in Canada.

MandyBlake 06-01-2005 12:01 PM

banks usually take more than one day to clear out of state checks.

Kevsh 06-01-2005 12:01 PM

Don't know about Americana, but here in Canada I had the teller put a note on my account to put each cheque (or "check") through immediately. After 5 or 6 cheques from the same company, they obliged. Now, no holds for any cheque, ever.

SetTheWorldonFire 06-01-2005 12:03 PM

Is'nt it faster now that they are scanning them?

it's all becomming digital is'nt it?

kernelpanic 06-01-2005 12:08 PM

This is why epassporte can be a benefit, however my bank never does that to me regarding out of state checks.

GatorB 06-01-2005 12:15 PM

My bank has never held and out of state check.

That's exactly it. I can not count the times in my life ( and I am sure many have been witness to this) i've seen. " I need to cash this check" patron " Ok sir, do you have an account with us?" -teller " No"- patron " Ok sir this is an out of state check it will take XXX days to clear. " - bank teller " you mean to tell me I can have my money??" - patron " No sir , I am saying this is an out of state check and it will take a few days to clear, would you like to set up an account?"-Teller.............................. Patron then proceeds to leave the bank angry and confused, complaining just loud enough for a few people in line to hear and shake their heads at the ignorance.

Patron then hops into his '84 caviler and heads off to the next bank. rinse repeat

jukeboxfrank 06-01-2005 12:34 PM

Thats what banks say to people that are getting an IRS audit. as they freeze your assets.

seeric 06-01-2005 12:37 PM

thats been the rule for awhile. just some of the banks said no to it. i guess the barcode big brother laws are hot and heavy and breathing down your necks now. its only a matter of time before there are microchips in the foreheads of americans and you have to get scanned when you go to a bank or restaurant or on the freeway. LOL.

its not unbelieveable or that hard to make reality.

SykkBoy 06-01-2005 12:42 PM

I bank with a credit union and have never had to wait for funds on an out of state check....or if I don't feel like driving across town to the credit union to cash a single check, I'll hit one of those cheesy check cashing places, pay the $4-5 and save on gas, traffic headaches and bullshit ;-)

bjjb 06-01-2005 01:59 PM

My bank has a policy that they only make 50% of the funds available till the checks clear. Usually takes a day or 2. I can wait.

Kimmykim 06-01-2005 02:04 PM

Actually this is not true. Checks, as of January of this year, now clear in hours, not days. And if they are less than $5000 USD, they don't trigger a CTR (cash transaction report) either. I'm not sure why your bank is doing this.

But there's a very simple solution imo -- get your money via ePassporte, and verify your ePassporte account. Then you can move money directly into your US bank accounts through ACH, have access to the money immediately with the Virtual Visa or Electron card, and don't worry about the wait.

boner 2.0 06-01-2005 02:05 PM

I'm fucked for 25 working days... I can't cash em before... :disgust

Snake Doctor 06-01-2005 02:16 PM

I think it depends on how much you have in your account.

If you're trying to cash a 5K check and only have 1k in the bank then they're going to make you deposit it and wait.
If you have more than enough in your account to cover the check should it bounce then there are no problems.

Although I still get hold letters from the bank sometimes, when I forget to go make a deposit and end up depositing 2 weeks worth of $$ at once they put a hold on some of the funds for a few days.
