2257 questions

if you run a text only tgp
and dont have any pics on your page
will you still need 2257 info for the gallerys you link to ?
soft nude banners , will they need 2257 info ?

what about amateur/voyeur sites like voyeurweb , they can hardly submit any info ?

cyber_ninja 05-28-2005 04:20 PM

sell it :2 cents:

StickyGreen 05-28-2005 04:23 PM

the law refers to "sexually explicit images" so if you dont even have images on your site obviously you dont fall under the law...

fireorange 05-28-2005 04:24 PM

Nah, not with text links.

No, as long as you don't host images or video on your server or hotlink them into your HTML pages, you do not need 2257 information.

The government uses several terms like "sexually explicit" which are not easily defined and some of their own definitions aren't clear. If the content is very soft, like artistic nudity, they would have a hard time convicting you, but there is always risk.

Voyeurweb is located outside of the United States, so they probably don't care. If you ran a site like Voyeurweb in the United States, you would definitely want to talk to a lawyer you trust.

There may be exceptions in the law for sites like Google, which could cover sites like Voyeurweb and Friend Finder, but it would not be certain.

You will have to decide what level of risk you wanted to assume based on a conversation with your lawyer.

All GFY members are lawyers - anything posted on GFY is considered to be fact in all U.S. Supreme Court cases.

Hmm maybe I should move all my tgp's to a Canadian host.

Won't work. Canada is a State.

From what I understand it only applies to images. If you don't host any images, you should be in the clear... but check with your attorney just to be safe.

s9ann0 05-29-2005 06:02 PM

I think 2257 is the end of TGPs

Answers like this are the ones that show you why you need a lawyer.

The definition of what is considered 'sexually explicit conduct' is very clear from 2256. The part of it being used for 2257 purposes is even clearer in that item e) was left out, the only one that might have lead to different interpretations (e > is based on the meaning of the word 'lascivious'). It was also left out the 'simulated' part of 2256 to further avoid gray areas.

Quit messing Mr.Fiction - ya know that ain't true! :-)

BUT... I got a PHD in law and my professional interpretation of 2257 is... ALL of it is sheer shit instigated by a *very* poor legislature manipulated by a few raving lunatics with an agenda. Only a deaf and dumb brain dead asylum patient could create this quality of legislation.

Do they still pay senators and whatever else in Washington to work there?? May need some reconsidering for the health of US taxpayers! :1orglaugh
