PORTLAND, Ore. -- A woman sued Yahoo Inc. for $3 million, alleging the Internet site failed to fulfill a promise to remove nude pictures of her from the Web.
Cecilia Barnes, 48, in a lawsuit filed Tuesday in Multnomah County, claims an ex-boyfriend began posting unauthorized personal profiles of her containing the photos in December. The profiles included her e-mail address and work phone number.
The former boyfriend also engaged in online discussions in Yahoo chat rooms while posing as Barnes and directing men to the profiles, the lawsuit claims.

"Due to these profiles and online chats, unknown men would arrive without warning at plaintiff's work expecting to engage in sexual relations with her," the lawsuit claims.

Barnes sent Yahoo a letter in January saying she did not create the profiles and wanted them removed. Additional attempts to get Yahoo to remove them in February and March did not get a response, the lawsuit claims.

A Yahoo spokeswoman declined to comment, saying the company does not comment on pending litigation

I think that a lot of the liability should lay in her lap. She allowed the photos to be taken, and allowed the photos to leave the house.

But the guy that did it should pay for the chat thing.

this suit should name two defendants, one the ex-boyfriend for defamation, etc and Yahoo for negligence, once a complaint was registered with Yahoo they should have responded by taking the profiles in question down, however due to the way Yahoo is strutured new profiles can be created as the old ones are removed, in the end the majority of the harm being done is by the ex, however Yahoo becomes liable after not removing the profiles. I dont think this will bring up any major issues for yahoo as they are not responsible for the content posted by others on their site. its kinda like saying the post office is responsible for damages caused by the unibomber because he mailed the bombs. Sorry but no......

I agree. Furthermore, what is to stop someone from claiming to be a person in a profile, and then asking that a picture be taken down (or profile deleted), when in fact it is not their picture/profile.

For example, you're pissed at someone, so you want to harass them by having their profile deleted or picture removed from their profile.

Back to the case at hand, the courts could easily compel the ex-boyfriend to delete the pictures, and impose a restraining order preventing him from engaging in the type of activity that he is engaging in.

To add one more wrinkle, if Yahoo is found liable, then people can conspire to set Yahoo up, by posting their own naked pictures, claiming it was done wrongfully, and then suing Yahoo for not removing the photos.

Yahoo will probably just pay the woman and her lawyer a few thousand to make the lawsuit go away, or if they fight it, they will probably prevail but could be out more money.
