I?m sure that many of you are wondering what OCCash?s plans are to comply with the impending 2257 regulations. Right now, we are in the process of talking to our lawyers to find out how we can best make ourselves and our affiliates compliant with the new regulations. Rest assured, as soon as we know how to most effectively deal with these new regs our webmasters will be the 2nd to know. We will do whatever it takes to make sure our affiliates can make their sites and galleries compliant by the time the changes in the regs take effect.

The new regulations are set to take effect on June 23, 2005. However, The Free Speech Coalition is seeking injunctions on both the East and West Coast. These injunctions are very likely (though not guaranteed) to slow the passage of these (or some components of) laws. In a best case scenario, the courts will uphold the Sundance vs. Reno decision regarding the responsibilities of a secondary producer and there will be no need for webmasters to keep redundant sets of model IDs.

If you are not a member of The Free Speech Coalition (www.freespeechcoalition.com), we highly recommend that you become one. The FSC is our first line of defense against an administration that is hell-bent on destroying the adult online business.

Lastly, do not give into fear mongers that are looking to make a buck from this debacle: there is not an acceptable third party whom can keep your records for you (should they become necessary) and the earliest there regulations could affect you is June 23 -- don?t fall victim to the profiteering that is already running rampant on the boards. Even if the injunctions fail, the government still needs to set an agency to enforce these regulations which will delay and inspections even further than June 23rd.

Now is a time for vigilance and not panic. OCCash will do whatever it takes to make sure our webmasters are covered just as soon as we have been given proper legal advice by our attorneys. It is still very early in this game to predict exactly what the future will hold.

Hey Jay, I agree with most of what you said except the part about the government needing to enact an agency to go out and do inspections.

They proposed the regs 11 months ago, I'd bet all the money in my pockets that they already have a large group of people trained and ready to go.
If there is no injunction the inspections will start on June 24.

#1. This is what I heard directly from our lawyer, who is Jeffery Douglas (chairman of the FSC) -- he said that they DOJ has not yet appointed an agency to do the inspections. In other words: it could be the FBI, it could be the Feds, or it could be local cops -- we just don't know yet.

#2. If there is an injunction filed by the FSC -- IT WILL ONLY COVER MEMBERS OF THE FSC. That is a fact. I disputed this yesterday with somebody on this board, but now have found this to be true. You could file your own injunction to avoid prosecution, but if you want to be part of the FSC injunction -- you need to be a memeber. End of story.
