Freridge May 25, 2005 FSC Recommends Compliance with Existing and New 2257 Rules & Regs Free Speech Coalition attorneys are reviewing the newly released revisions to the Federal Labeling & Recordkeeping Law, 18 U.S.C. in preparation for the legal challenge FSC intends to mount on behalf of our membership. However, being a member of the Free Speech Coalition does not mean that compliance is unnecessary. Every producer of actually sexually explicit conduct is covered by the existing regulations and the new regulations (which take effect June 23, 2005). The Free Speech Coalition will initiate litigation to seek an injunction against the law generally as well as specific parts of the regulatory scheme. While we are confident that we should receive injunctive relief of some sort, and are hopeful that such an injunction will be broadly based, there are no guarantees. We do not and cannot promise that an injunction will issue, and if it does, what components of the law and regulations will be covered. We urge every member of the adult entertainment and information community to be compliant with the law and regulations, and to be prepared to comply with the new regulations, insofar as possible. If we get the injunctive relief we seek, then we will inform our members what rules are covered by any injunction. Under the Federal Rules of Civil Procedure, only the parties to litigation are covered by an injunction. Therefore only the Free Speech Coalition and its members will be covered by an injunction and only to the extent the injunction restricts the government enforcement. He's saying that even if there is a challenge in the court, you still have to comply with the regulation until the regulation is upheld or revised. If there is a hold on enforcement for those who are a party in the lawsuit, you still should be working on complying, but they won't inspect you until a final ruling is rendered. Understand? |

But if the FSC said they would NEVER release their members list how in the world would their members be covered? Show an ID card when the feds knock on the door???? or are they going to mail the DOJ a members list - which is equally as scary.

Your $300 is basically buying you a little time to get your house in order... they'll leave you be until, as said, it's either revised or upheld... then they knock on your door.
But you will still have to be compliant one way or another. Either in it's entirety or not. So why sit around on your hands... find out that 2 items have been changed, now they're going to take action and you JUST START to go "ok, so we can do it like this... let's begin organizing our documents." |
the big question how would the dojs know who is protected and who isnt.Its very short sighted on their part, the amount raised in fund raisers for them would surpassed the amount they are twisting arms for.
