UK court bans online porn sales (May 24th)

Pornmongers in the UK can no longer send videos or DVDs through the post or sell them online.

Sex shops in the UK cannot sell adult material except to people who visit their premises. The High Court ruled yesterday that such restrictions are legal because they help prevent pornography being bought by children.

Two UK companies brought the appeal after being fined by Trading Standards for selling restricted material by post. They argued that the ban was unfair because companies outside the UK would ignore it and damage British businesses.

But the judgement said the restrictions are lawful. The main reason for ensuring a face-to-face meeting between seller and buyer was to make sure the buyer was old enough.

Lord Justice Kay accepted that children under 18 might manage to subvert such restrictions but that did not justify removing them.

Two companies, Interfact Ltd, with a shop in Bexley, and Birmingham-based Pabo Ltd, fell foul of trading standards last year after offering age-restricted videos like Bikers? Gang Bang and Top Marks for Effort through their online catalogues

I'm not sure those two have ever criticized another government besides the US in this forum. Sorta like the Bush veto. Will it happen today?

Johny Traffic 05-25-2005 04:29 AM

This is a very old law. Its always been the law. There has been no change in the law.

Its always been illegal for UK companies to send R18 Videos and DVDs through the post. Nothing has changed.

Somebody tried to overturn the law, the judges wouldnt overturn the law. So it remains as it always was. DVD companies have to ship them from Europe and not the UK or sell them in sex shops. Exactly the same as they have always had to do

Her point was not that it was Videos & DVD's her point was the is an existing law that has always been there. But someone made an appeal after they got found guilty of the law, they tried to overturn the ruling on the existing law. The judge wouldnt overturn the verdict and so enforcing an existing law thats always been there.

See the part above the author's name? It's called the title. If you read the article you will understand why.

Yes, I read the article and I also read Sarah's post on another board this morning.

Johny Traffic 05-25-2005 05:04 AM

The article is very misleading, as it says "Pornmongers in the UK can no longer send videos or DVDs through the post or sell them online" It shoul in fact say "Pornmongers in the UK still cant send videos or DVDs through the post or sell them online"

Misleading title.

It wasn't banned... a ban was upheld.

When have I ever given a fuck about who bans sending porn DVD's through the mail? Find a post where I did. Like I could give a shit.

Besides, I don't remember hearing the English screaming about freedom all the time like you simpletons do.

So perhaps if you Americans shut your fat, ignorant, arrogant pieholes for a minute (and stopped invading other countries) the rest of the world wouldn't be so interested in what you mongrel fuckups did.

I know I wouldn't.

P.S. England is your mother country too.

LOL ... Could have started a new thread, with at least 10 items about the US Administration ...

Here is one :

Quote:

US SLAMMED OVER RIGHTS

The US 'war on terror' has had a drastic impact on human rights worldwide, Amnesty International has warned.

And the US is among the worst culprits at eroding basic rights.

"The USA as the unrivalled political, military and economic hyper-power sets the tone for governmental behaviour worldwide," Secretary General Irene Khan said in the foreword to Amnesty International's 2005 annual report.

"When the most powerful country in the world thumbs its nose at the rule of law and human rights, it grants a licence to others to commit abuse with impunity."

The organisation said last year's abuse pictures of detainees at Abu Ghraib prison was never fully probed and the detention of inmates without charge were good examples of America's attitude.

"The detention facility at Guantanamo Bay has become the gulag of our times," Ms Khan.

Hundreds of people are being held in Guantanamo and the US airbase at Bagram in Afghanistan - some for more than

three years - without charge and with no access to legal representation.

Ms Khan said America's actions had "made the security situation worse".

She accused the US of 'subcontracting torture' to get information from detainees.

"The US government has gone to great lengths to restrict the application of the Geneva Convention and to 're-define' torture," she said.

"Governments are trying to subcontract torture. Justice is not just being denied it is being diverted," she said.

"To argue that torture is warranted is to push us back to the Middle Ages."

Colombia, Sudan and Zimbabwe were also singled out for criticism.

I think it's a good idea, personally. Anything reasonable that helps prevent porn getting into the hands of minors is a good step... and this certainly sounds like a reasonable step.

Of course, it does kind of open the flood gates doesn't it? Until the adult industry (or anyone else for that matter) can come up with a way to better ensure they are not selling their content to minors, expect to see more of this.

How much for a troll that would accuse Lensman of shaving with fake screencaps? :upsidedow

MrChips 05-25-2005 10:04 AM

Seriously

So - is it legal for a UK website, run by a uk business, hosted in the UK, to sell memberships to a members area where the visitor found the site online.

Lets say an english company, registered in england, hosted in london - had a pay porn site (with the same content type that is banned by the current law as mentioned - re posting etc), where customers joined ONLINE with their credit card.

Is that english company breaking english law?

Sarah_Jayne 05-25-2005 10:11 AM

it isn't banned content....it is the PHYSICAL item. It is hard to explain the different comissions that govern different sides of things. I sort of understand your point but (for now) this particular ruling is about physical goods.

Welcome to the world of confusion that is being a smut merchant in the UK. Though anyone that hosts hardcore porn in the UK needs to be shot anyway.

MrChips 05-25-2005 10:19 AM

Ok

Well - I host in the US, but only softcore really.

Is it legal for me as a UK company to earn commission from nastydollars for example - by driving traffic to their sites through SEO with pages containing banners etc
