UK court bans online porn sales (May 24th)
Pornmongers in the UK can no longer send videos or DVDs through the post or sell them online.
Sex shops in the UK cannot sell adult material except to people who visit their premises. The High Court ruled yesterday that such restrictions are legal because they help prevent pornography being bought by children. Two UK companies brought the appeal after being fined by Trading Standards for selling restricted material by post. They argued that the ban was unfair because companies outside the UK would ignore it and damage British businesses. But the judgement said the restrictions are lawful. The main reason for ensuring a face-to-face meeting between seller and buyer was to make sure the buyer was old enough. Lord Justice Kay accepted that children under 18 might manage to subvert such restrictions but that did not justify removing them. Two companies, Interfact Ltd, with a shop in Bexley, and Birmingham-based Pabo Ltd, fell foul of trading standards last year after offering age-restricted videos like Bikers? This is a very old law. Its always been the law. There has been no change in the law.
Its always been illegal for UK companies to send R18 Videos and DVDs through the post. Nothing has changed. Somebody tried to overturn the law, the judges wouldnt overturn the law. So it remains as it always was. DVD companies have to ship them from Europe and not the UK or sell them in sex shops. Exactly the same as they have always had to do |

So - is it legal for a UK website, run by a uk business, hosted in the UK, to sell memberships to a members area where the visitor found the site online.
Lets say an english company, registered in england, hosted in london - had a pay porn site (with the same content type that is banned by the current law as mentioned - re posting etc), where customers joined ONLINE with their credit card. Is that english company breaking english law? |
it isn't banned content....it is the PHYSICAL item. It is hard to explain the different comissions that govern different sides of things. I sort of understand your point but (for now) this particular ruling is about physical goods.
