Am I reading this right? U.S. producers can't shoot foreign models?
 
According to 2257 Sec. 75.1 (b), you must have a picture identification card from the U.S. government, Washington D.C., or "a foreign government-issued equivalent of any of the documents listed above when both the person who is the subject of the picture identification card and the producer maintaining the required records are located outside the United States."

And, would this apply to affiliates, too? Meaning, if the model is from another country, and the producer must be outside of the country as well, are secondary producers (affiliates) affected as well?

This doesn't make a lot of sense, so people in the USA can only use content of models who are not American if the producer is outside the US as well? WTF? I'm glad I'm Canadian and not a content producer, this shit would give my attorney a headache.

That's what I'm wondering, too. It clearly states what IDs are acceptable, and it states that a foreign ID is only acceptable if the producer and model are out of the U.S.

this means that they are both located outside of united states at the time of the actual shoot. You see it as: "producer has to be operating outside of the US in order to use foreign models and their Id's"

Adam - in 2257, as i understand it, it now states that the term producer also includes secondary producers. so anything you read in 2257 that says producer and doesn't specifically exclude secondary producers would include them.

i see you could push that ruling since it doesn't say "only", but i also take the worst-case scenario in my interpretation, which would mean that u.s. producers can only use u.s. i.d. :(

That's what I was thinking, too. We plan on talking to our attorney, Larry Walters in the coming weeks, but I just figured I would ask and get as many answers as possible now.

We have a shoot that was done with a girl from Australia, and it was done here in the U.S. She had an Australian passport, but under these rules, that shoot cannot be used because it is in violation of 2257. Correct?

According to this, I cannot produce a site with content from a foreign country. Since I will be the secondary producer, and I am in the U.S., and the model's ID will be from CzechPolGerFranRussiamany, then I would be in violation, correct?

this is not what i was told by my attorney. I asked the other day about foreign id's and from what i was told it isnt a problem.

I could be wrong, I could have asked him wrong and he misunderstood me.. But, one thing for sure is too many people without attorneys are commenting on this crap who dont know much at all about this and it's stirring up alot of stuff. Get an attorney and dont ask anything this important on gfy. How could gfy, even on its best day, subsitiute for the advice of an attorney. So much of the new 2257 regs have been interpreted by sig whores. Lets step back a second and breathe. Next step is get an attorney. It's that simple.

Our attorney is Larry Walters, and we have not consulted him about this yet. To be honest, I am trying to get a list of things to go over with him ahead of time, so I'm not unprepared and spending $350 an hour trying to think of what to say, lol. I have a short list so far, and most items can be figured out by reading over and over until it sinks in, but this one thing has me a little confused.
