Am I reading this right? U.S. producers can't shoot foreign models?
According to 2257 Sec. 75.1 (b), you must have a picture identification card from the U.S. government, Washington D.C., or "a foreign government-issued equivalent of any of the documents listed above when both the person who is the subject of the picture identification card and the producer maintaining the required records are located outside the United States."

And, would this apply to affiliates, too? Meaning, if the model is from another country, and the producer must be outside of the country as well, are secondary producers (affiliates) affected as well?

Adam - in 2257, as i understand it, it now states that the term producer also includes secondary producers. so anything you read in 2257 that says producer and doesn't specifically exclude secondary producers would include them.
i see you could push that ruling since it doesn't say "only", but i also take the worst-case scenario in my interpretation, which would mean that u.s. producers can only use u.s. i.d. :( |

According to this, I cannot produce a site with content from a foreign country. Since I will be the secondary producer, and I am in the U.S., and the model's ID will be from CzechPolGerFranRussiamany, then I would be in violation, correct?

this is not what i was told by my attorney. I asked the other day about foreign id's and from what i was told it isnt a problem.
I could be wrong, I could have asked him wrong and he misunderstood me.. But, one thing for sure is too many people without attorneys are commenting on this crap who dont know much at all about this and it's stirring up alot of stuff. Get an attorney and dont ask anything this important on gfy. How could gfy, even on its best day, subsitiute for the advice of an attorney. So much of the new 2257 regs have been interpreted by sig whores. Lets step back a second and breathe. Next step is get an attorney. It's that simple. Duke |
