Ones ran by US webmasters only.

Trax 05-24-2005 09:56 AM

I don't see them being good, regardless if you#re a european webmaster or not
do you host outside of the US already?? I somehow doubt most european webmasters do

RawAlex 05-24-2005 10:01 AM

Got us sponsors?
got us hosting?
get paid by us payment processors?
accept submissions from us webmasters?
buy content from us producers?
Any part of your business trail touches the US?

Any of these things (and many more) enter you into a contract to commercially producer and distribute sexual images. You can run but you cannot hide... the rules apply.

If you are hosting outside of USA, use non-USA biller, don't live in the USA and don't use a USA based corp, all the above you can do ...

I can buy today and tomorrow photos and/or videos without the 2257 if I am not American as above ...
As much as I can sell the same without the 2257 to US webmasters. Not illegal for me, but for the buyer to display them ...

Anyway, at least, it is going to prevent childporn .... :1orglaugh :1orglaugh :1orglaugh

Can you elaborate on that..? If I bought some content for a US producer but didnt get all the documentation.. For the 2257, I basically refer to the adress of the producer, etc... As a non-US webmaster.. how the new 2257 regulations affect me on this.. ?

You operate a site out of the US and completely clear of the US. Who will prevent you of "publishing" a set of pictures of a model without 2257 ????

The only time a foreigner can really get in trouble is if the models looks like under 18 and IS under 18. Naturally, in such a case , documents are a part of the defense.

I can tell you I refused to shoot a girl that looked like 14 , even tough she insisted and showed me what seemed to be legitimate documents... But it was not worth the heat and the risk.

As for CC processors, when Visa reviews the site, they checked for the 2257 presence. Now, they will check a bit more ...

polish_aristocrat 05-24-2005 10:25 AM

hey btw how are the new 2257 rules different than the ones from few months ago?

few months ago also everyone said it's the end of the world and nothing happened

No but my main concern is.. can the US producer tell me my license is not valid anymore because he now needs to somehow have all his clients to follow the new 2257 regs..? Guess that will happen after june 23rd 2005.. but as I understand.. it shouldnt matter.. if the content was shot prior to that right.. ?

YankBro 05-24-2005 10:31 AM

Visa and MC will cut a foreign site down in a second if the fed's question their 2257 records. Not be a downer or anything but this appears to be the point to me. The feds know the industry will fall to shit once Visa & MC crack down on who they do business for/with.

The "primary" producer has to supply to US BASED sites the docs. He has no obligation to supply Foreign based sites with those documents if he does not wish to. The USA gov cannot come and arrest him because he did not supply to a Russian based site the 2257 ...

Naturally, it is a good idea to ask and have them, if only to show that he actually owns the content you are buying ....

This before and/or after June 23rd. 2005

Not if you process out of the USA zone. 2257 are nothing out of the USA.

VISA EU
VISA USA
http://en.wikipedia.org/wiki/VISA

IIRC, there is no $750 fee for EU sites?

FOR ALL OF YOU WHO THOUGHT BEING OVERSEAS MEANT THAT 2257 DIDN'T APPLY TO YOU:

"The rule is no different from other forms of labeling requirements imposed on foreign producers of, e.g., alcohol, tobacco, or food items that are imported into the United States. In order to sell in the U.S. market, foreign producers must comply with U.S. laws. This rule applies equally to any sexually explicit material introduced into the stream of commerce in the United States no matter where it was produced.

Foreign producers have the option of not complying with the rule, but then their access to the U.S. market is justly and lawfully prohibited."

I think that's for foreign producers who want to sell their content to US sponsors, i.e. not affiliate webmasters.

For producers. Same would apply as an example to americans selling goods into Canada:
We use metric, so you make your labels with metric measures ....

Produce hc photos/videos ? Want to sell to US sites??? Nedd the 2257 in the form that the USA required it.
