So if you buy a house.....
 
If you buy a house that costs $300,000.00 and you make a down payment then finance the rest......

Lets pretend that you fall behind on your payment and the house is repossessed by the bank......

How many of you think that the bank is going to give you your money back? Do you think that they will say...Well, you've paid for 75% of the house so we will let you keep 2 bedrooms, the kitchen, and half of the living room?

OR......


You enter into an agreement to buy a porn site. There are payment terms discussed as well as legal rights about the content licensing on that site and you are required to follow those terms and license.

If you can't make the payment on that site OR you violate the terms of the sale....You will lose the site as well as any and all money that you invested into it.

Now, there are a million ways that people could spin these two situations but the bottom line is that the bank would repo the home, auction it off, and not give the prior owner a single dime. In the case of the website...You would lose your investment there as well.

Both of these situations have happened and will continue to happen as long as people are buying and selling things on terms and or issuing limited licenses.

If you can't complete the deal without violating the terms then perhaps you should not be considering the deal in the first place.

If you don't agree with this then you need to take some business courses and find out how the real world works.

I know in Massachusetts if you owed say 50k on a 300k dollar home they would foreclose on the property and auction it off. If they sold it for 250k, they would take the 50k you owned on it plus whatever their legal fee's were and give you what was left over. :2 cents:

Generallly with a foreclosure on a home there is a series of missed payments that occurs before the bank closes in. With your deal with Sos you didn't give him the opportunity to make the series of payments to pay off the remaining balance that he says you agreed to in your conversation after you told him you needed US currency and he was short. If in fact you told him he could use the content to start his site and then make payments to pay off the balance, then you never gave him that opportunity and essentially prematurely foreclosed according to your example. Obviously the key seems to be the icq logs that discussed the agreement after you told him he still owed a balance. There seems to be some discrepancy as to what exactly was agreed upon at this point.

Verbal/Oral contracts suck because one can always orally/verbally change it. There was no contract, there was no license given therefore there was no violation IMO.

So lets say you made all the payments on that 300k house except the last.

You owe the bank 1 more payment, lets say 1k.

The bank reposesses the house and sells it for 300k - 1k owed on the loan, and the bank keeps the 299K?????????

The bank sold the house to payoff the debt, anything left over goes back to the owner.

Now,,,,if we are talking about peoperty taxes you would be correct. Just recently the county here seized an 800k home b/c the owner owed 50k in back taxes. The county auctioned the house for 750K,,,50k went to settle the back taxes and the county pocketed the 700k.

So what if someone bought a million dollar home with all cash then took out a 25k loan for a pool. What gives the bank the right to steal his million dollars if he defaults on the 25k?

actually the bank will give you your $$ back.

if you owe the bank 200k and they sell the house for 250k you will get your 50k back.

in reality tho if you owe the bank 200k by the time they are done with charging you late fee's forclosure fee's you probably owe them 300k so you would not see a dime.

Dont they give the homeowner the profits after reposessing and selling the house? They keep what they are owed, the old owner got the rest? Thats the way I've seen it happen.
