Prostitution vs. Shooting a porno
I always wondered what the difference was between paying a prostitute for sex and filming a girl you are having sex with (legally), like those point of view movies do.
I am in no way comparing porn stars, or porn girls to prostitutes, but what makes a girl having sex in front of a camera legal if she signs a contract and not a prostitute? Is it bearly the fact that she is signing a contract? Could a prostitute set up a home business where she legally films herself having sex with regular joes while never publishing the content? |

the difference is paying taxes or not paying taxes. I'm sure if the gov't can have a way of tracking & controlling how many clients, money, etc a prostitute or escort brings in then it would be legal.

The correct answer, gang, is Miller vs. The State of California, and I think it was 1972. Also, I'd like to add that it's really pandering we're talking about here, not prostitution...unless you're shooting a POV.
Miller argued, basically, that since there was a plot to Deep Throat, it was, in a way, legitmate art...sex just happened to be in it. The judge agreed, and, in fact, this is the only place in the country this thing has been tested...that's part of the reason Porn Valley became Porn Valley. Pandering is paying people to have sex in front of you, whether or not there's a camera in the room. In my state it's a Class 6 felony...SO, the moral of the story is...make your porn have a "plot" no matter how silly it may be! |

Here is the California law about prostitution, some states may be different.
CALIFORNIA CODES PENAL CODE SECTION 653.20-653.28 653.20. For purposes of this chapter, the following definitions apply: (a) "Commit prostitution" means to engage in sexual conduct for money or other consideration, but does not include sexual conduct engaged in as a part of any stage performance, play, or other entertainment open to the public. ------------------------------------------------------- My understanding is if you pay someone to have sex with you and film it, then distribute it then that would be legal. But if you pay someone for sex and don't film it or let others watch that that would be illegal. Contact your lawyer to make sure. |

There is a company in vancouver canada that basically works the way you suggested except one step better its free..
