People using music illegally in banners

pathetic

DutchTeenCash 04-15-2005 02:52 PM

yeah made a post bout that, isnt 2 secs for free like most music is here in the EU (samples)

Fletch XXX 04-15-2005 02:54 PM

samples have NOTHING to do with using music in banners for PROFIT

NOTHING

Fletch XXX 04-15-2005 02:55 PM

Ok well laws arent the same everywhere. You can use samples here for commercial goals too. If youre putting music under a banner and its like 30 secs then its wrong imho.

Using it to profit is what the whole problem would be... you CAN under some circumstances use a few seconds of music as a sample but it can NOT be resold or used for profit...

true, but isnt it different for the web? Can I just buy 1 min royalties for a dutch song and put it under a banner hosted in the US? I wouldnt know...

I remember when Lightspeed was using Biz markies "Just A Friend"

I actually linked where Biz markie himself was SUED over the song, now they want to use it in a banner and think its legit?

:1orglaugh

everytime this comes up, Im glad my first knowledge is music industry and second is porn.

you are correct.

profit is what makes it different.

Fletch XXX 04-15-2005 03:07 PM

SAMPLES MUST BE LICENSED

Is sampling theft? When rapper Biz Markie sampled the melody of Gilbert O'Sullivan's 1972 hit "Alone Again, (Naturally)" for his song "Alone Again" on his 1991 album I Need a Haircut, he was only following in the footsteps of countless other rappers. Unlike the others, however, Markie went to court. After O'Sullivan denied Markie the right to use his song, Markie used the sample anyway, and O'Sullivan filed suit. Ignoring the nuances of copyright law and artistic creation, Judge Kevin Thomas Duffy likened Biz Markie to a common thief, stating, "Thou shalt not steal has been an admonition followed since the dawn of civilization." Upon rendering his verdict, which included an injunction against the future distribution of the album and the song, Judge Duffy referred the case to a U.S. district attorney for possible criminal prosecution. Although Biz never served time for his alleged violation of the Seventh Commandment, the case did set the precedent for viewing unlicensed sampling as a crime.

Steve Lightspeed

Fletch XXX 04-15-2005 03:10 PM

im not whining about you Steve.

Just bringing up a point.

I hate when program owners talk to affiliates like this.

This board is here to discuss these things, nothing else.

No profit for you but HUGE losses for the music industry. Not sure which is better...err worse.

seeric 04-15-2005 03:27 PM

i've been telling people that for years. no one listens. thats huge copyright infringement. sampling laws dont cover that. i know. my lawyer represents some of the biggest people in hip hop and pop.

Fletch XXX 04-15-2005 03:28 PM

anyyyyway... wanted to make a good thread for today.

mission accomplished.

off to get some food, enjoy your day all.

Dirty F 04-15-2005 03:28 PM

That banner wont hurt the music industry...at all. Your sharing of 1000's of mp3's does.

ronaldo 04-15-2005 03:32 PM

Bloody hell. You mean I can't use anything I find on the internet in any way I want?

Boy, I have a LOT of people to apologize to.

seeric 04-15-2005 03:38 PM

i didn't read the whole thread only the first. i don't know nor care who used anything, all i am saying is i been in the music biz for 15 years almost. i know what i know. i'm not a lawyer, and don;t play one on t.v. people do what the are willing to be responsible for. not my business.don't intend it to be. those using music in thier banners must know more than me or have a lawyer that does. thats all im saying. im the last one that will single anyone out. i have been putting out bootleg cds for 10 years. not a thing anyone can do about it unless i start selling them.
