Using it to profit is what the whole problem would be... you CAN under some circumstances use a few seconds of music as a sample but it can NOT be resold or used for profit...

Is sampling theft? When rapper Biz Markie sampled the melody of Gilbert O'Sullivan's 1972 hit "Alone Again, (Naturally)" for his song "Alone Again" on his 1991 album I Need a Haircut, he was only following in the footsteps of countless other rappers. Unlike the others, however, Markie went to court. After O'Sullivan denied Markie the right to use his song, Markie used the sample anyway, and O'Sullivan filed suit. Ignoring the nuances of copyright law and artistic creation, Judge Kevin Thomas Duffy likened Biz Markie to a common thief, stating, "Thou shalt not steal has been an admonition followed since the dawn of civilization." Upon rendering his verdict, which included an injunction against the future distribution of the album and the song, Judge Duffy referred the case to a U.S. district attorney for possible criminal prosecution. i didn't read the whole thread only the first. i don't know nor care who used anything, all i am saying is i been in the music biz for 15 years almost. i know what i know. i'm not a lawyer, and don;t play one on t.v. people do what the are willing to be responsible for. not my business.don't intend it to be. those using music in thier banners must know more than me or have a lawyer that does. thats all im saying. im the last one that will single anyone out. i have been putting out bootleg cds for 10 years. not a thing anyone can do about it unless i start selling them.
