LOUDOUN COUNTY, Va. ? Jeremy Jaynes, the first man convicted in America on felony counts of illegal spamming, has received a nine year prison sentence for his role in sending out millions of unsolicited commercial emails. Once considered to be among the dozen most prolific spammers in the world, the 30 year old North Carolina man was convicted this past November for using spam emails to sell online pornography as well as bogus products and services ? earning him as much as $750,000 per month from his criminal enterprise. Bit excessive punishment if you ask me |
He was ripping people off... Thats why he is in all this trouble. The news is just bending the story.

yeah, it should be noted his sentence was not for sending email itself, but selling fraudulent products.

He was convicted under a state law. There's many grounds for appeals. The obvious one is whether the constitutional speech protections afforded to junk physical mails applied to emails.
Unfortunately, it appears he cannot appeal based on whether the federal CAN SPAM Act superseded all similar state statutes due to federal supremacy on Commerce Clause issues. CAN SPAM prohibits proxy IP cloaking or fraudulent headers. |
I haven't had time to really look at the reports on this case, if he was sentenced for bogus products/service, then the sentence could be reasonable to me....if only sending emails with advertisements for real products, definitely excessive in my opinion.
