Convicted spammer sentenced to 9 years
I hope this sticks, send these fucking spammers a message.
http://www.msnbc.msn.com/id/7432555/ LEESBURG, Va. - A man convicted in the nation's first felony prosecution for illegal spamming was sentenced to nine years in prison Friday, but the judge postponed the sentence while the case is appealed. Loudoun County Circuit Judge Thomas Horne said that because the law targeting bulk e-mail distribution is new and raises constitutional questions, it was appropriate to defer the prison time until appeals courts rule. Jeremy Jaynes was convicted in November for using false Internet addresses to send mass e-mail ads through an AOL server in Loudoun. Prosecutors said Jaynes sent more than 10,000 spam e-mails over three days in July 2003 from his Raleigh, N.C., area home, using the Internet to peddle sham products and services such as a "FedEx refund processor." A jury had recommended the nine-year prison term. Jaynes told the judge that regardless of how the appeal turns out, ?I can guarantee the court I will not be involved in the e-mail marketing business again.? Lisa Hicks-Thomas, the prosecutor, said she was pleased with the ruling and confident that the law would be upheld on appeal. ?We?re satisfied that the court upheld what 12 citizens of Virginia determined was an appropriate sentence ? nine years in prison,? said Hicks-Thomas. |
9 years is too much
|
So for one burst of spam that was only 10,000 emails he gets 9 years? Im certainly against spam, but that is a bit ridiculous considering how much long term spammers send, I mean I have a mailbox with more than 17,000 spam emails, I think 9 years is way overboard.
|
9 years for spamming.
Homicide: Average sentence = 12.4 years. Average time served = 5.9 years. Fucked up. |
I hate spammers but 9 years is WAAAAY too much.
|
He's stupid for just not settling with whoever was suing him. Theres really no defence in a spam case. You either own the domains/servers or you don't and no company will go after you unless they know for sure its you.
|
in those nine years he can teach alot of other cons how to spam.
fuck that. shoot em! |
muhahaha, nice

wtf 9 years for 10k emails ??
HAHAH i get 10k of spam to my own accounts over 3 days thats insane. I could hook the feds up with 1000 people to send to jail for 9 years |
hahaha,
I can't wait to see some of you in jail. You're white trash to begin with. You will fit right in! :thumbsup |
more like 4 months..that is INSANE for 10k emails....seriously, that is just mental!
|
muggers and robbers get worse than that. thats BS - it's a white collar crime, he should be fined, not jailed.
|
9 years is ludicrous for a non violent crime.
|
forget jail.. give the spammers to us
we'll set them up in a conference room in vegas - invite all the gay webmasters - then have the spammers asses tattooed with the phrase, "opt in" problem solved |
I hate to go with the majority but WTF? 9 years for a relatively small amount of spam is crazy. The guy deserves a short stint inside but 9 years????
|
HAHAHAHAAHAH GREAT NEWS...going to get some manlove for only 9y...life is great eh ;)
|
wait wait wait , i just re-read that , he was using forged headers..
THAT is fucked up , i HATE people who do that .. someone is using one of my domains for that shit and when i find the guy i will pull his teeth out one by one |

9 years is a lot but there needs to be a message sent. Spam has destroyed any legitimacy the internet had. It is the seed of most scams, and it has caused legitimate businesses to get their email blocked or trashed through spam filters. Not to mention all the resources it uses that we all pay for. |
Jaynes sent more than 10,000 spam e-mails over three days
:1orglaugh :1orglaugh |
Should have gotten 20.
Time to send a message to spammers that spamming is unlawful and people are tired of it. :thumbsup |
That's fucking bullshit, not saying he doesn't deserve it but how do they justify giving someone 9 years for spamming when I could go out, rape a 2 year old and be scott free in 3 months??
The legal system is fucked. |
spamming would be the WORST fuckin thing to go to prison for ... everyone would know you were a nerd and you'd get your ass busted in half day 1 ... and every morning after that

9 years is way too much.
1 year I could see and even that is too much. You can go kill and get off in 3 years. |
too bad for them
|
damn 9 years for that little bit. crazy
|
9 years eh? You get less if you kill someone in Holland.
Fucking insane. |
:thumbsup
|
It wasn't just for spam. He was scamming people also.

thats sick!

As much as I hate spam myself, I fail to understand why it's illegal. Before I drop kicked my home phone I got three or four calls a night from telemarketers. And it's become difficult to figure out which mail from the post office is real compared to junk mail.
|
Very good!
They should give more to the top guys and send a message that it must stop. A Texas death sentance would do the trick. |

What the fuck are you talking about? Who the hell gets 3 months for raping a 2 year old? This myth that people get barely any time in prison for crimes is bullshit, especially at the Federal level. There are thousands if not hundreds of thousands of people serving 10 year or more sentences simply for the posession of small amounts of drugs. There are over 2 million people in state and federal prisons now, you would be surprised at the sentences that are handed down these days. |

I personally think 9 years is too much.
But it's a new legal realm. It obviously sends a clear message. That's the important thing. |

Tell that to my girlfriend I had at age 17, and my girlfriend I had at age 20. Both were RAPED by their grandfathers at age 2. The two perverts got 2.5 and 3.5 months. |

9 years for sending out 10k emails. that is fucking stupid.
|
and at the time of his arrest was considered among the top 10 spammers in the world
prosecutors said Jaynes operation grossed up to $750,000 per month There's nothing in that article about 10000 mails in three days, plus the guy was a SCAMMER as well:: used the Internet to peddle pornography and sham products and services such as a hahaha147;FedEx refund processor |

I would more be questioning why you keep attracting women that were raped by their grandfathers at age 2. |
The products he was pushing were scams. The old FedEx scam is what got him into deep water. This isnt so much about the sending of an email message itself it is what the content of the message was. Its one thing to spam a legit product and get heat but fraud is another.
The media and anti-spam people love to twist this like hes getting 9 years for just spamming something. He would have gotten time if he was handing these fliers out at a mall because of the fraud involved. |
9 years is excessive but switch your thoughts for a moment to the fact that many of those responsible for the most aggressive spam in your inbox are also the ones invading the voice side of your telephone line. The 10,000 UCE this spammer was charged with was most likely the tip of his iceberg and the easiest provable. There should be leniency for dumbasses that get caught up in a "get rich quick" scheme but those who know the system and aggressively work to defeat it should get fucked under the jail. Obey CAN SPAM and "do not call" and you can reach a bunch of people :glugglug
