Moving to the USA [Advice needed]
 
I'm planning to move soon to the USA, and i'd like some advice :
Is it hard for Europeans to stay there "legally" for a year or two without leaving the country each 3-month period ?
Will it be hard to relocate my internet biz there ?
What would be the best way to get papers to run an adult biz from there and can i deal with some US companies for that ?
Please send me some good links or experiences :thumbsup

you can get a 9 month visa pretty easily with an immigration attorney

why re-locate your business to the states? if you're in the EU, you can keep your business where it is, register your address as changed and you won't be taxed any differently since the double taxation laws mean you only pay tax in 1 country

Well, I would actually suggest to look in the yellow pages for the area you want to go to and find an attorney around that area. That is the way I did it. Best to find a local attorney with who you cant talk with before you enter the US and sit down in person once you get there.

Well i was also thinking to move to some other countries outside Europe, but if i can get a regular situation in the states, i think i'll get a better life with my revenues in Euro for the moment.
I live in a nearly tax free zone for the moment, but after a few years, i think i'd better spend on taxes and get something in return.

The laws for aliens working in the U.S. have become very strict since 9/11.
Unless you are sponsored by a US company you will not be able to work in the US legally until you establish a working visa. And unless you provide a unique service that cannnot be found in the states its very difficult to get a working visa...

if you actually have money its very easy to get a greencard

its America ANYTHING can be bought ,a greencard goes for something like $375 000 last time I checked, its 100% legal to buy one , so its not like you have fake papers or anything , no you can just buy a greencard just like you buy anything else


its not cheap, but if you have $$$$ $375 000 isn't all that much for a permanent working and living permission

That's the point, do working visa are the same for someone willing to find a job in the states and someone willing to run his existing biz there ?
Because i know it's hard to get a working visa.
I'm just looking to spend my european money legally there

I dont think you will actually lose that money , the deal is , that you have to invest that $375 000 in a us based company , and sign papers taht you will not take it out for at least 10 or 15 yrs

so if you invest wisely , you could get a nice return , or of course lose it all

whats the story with that, whta are the basic requirements for a company to sponsor somebody?

i was actually about to make this same thread, i've been effectively living in the states for a while but going back and forth to canada every few months is a drag. trying to find a good immigration lawyer right now but some background info would be great

You can get an E visa (I'm not sure about the visa letter designation) for investors. As long as you can prove that you have enough capital to move a business to the US and you actually will employ people there, you can get the visa. The great thing about it is it lets you take your wife and kids with you. Once your business grows (thereby maintaining your business over certain asset/income/employee levels), you can apply for permanent residency (green card).

That would be a better solution, but the best would be to keep my internet biz as it is because i can't bring my spanish employes with me. I just want to receive my money each month in the states and get out of europe.

You can also try setting up a main office at your country for your corp and moving to the US to setup a satellite office. This MAY (again, consult with an immigration attorney) help you qualify for a LESS CAPITAL INTENSIVE L visa (intercompany transfer). L Visa also helps you bring your wife and kids (if any) with you.

Remember to check with your immigration attorney first before making a move.

The MOST COMMON way people with no existing family connections (family petitions) move to the us is through JOB petitions. Thanks for the advice :thumbsup I'll check an immigration attorney. I'll go in Miami in a few weeks to find that.
But i don't really think that being an "adult" Webmaster goes well on an immigration petition :(

It is nearly impossible for an average person to immigrate legally to the US these days without family already here or lottsa money.

-A fake green card might fool the club doorman but will get you arrested and deported(probably 5 year ban) the first time you try to enter with it and they run it through the scanner as whatever number is on it will be fake or won't match your passport.

-Coming back and forth on a tourist visa even from Canada is a high stress short term solution as you will always be wondering "will they let me in next time?"

-To get an employment visa you need to be an individual of exceptional talent/skills and you need an employer to sponsor you and do a ton of paperwork and actually work in that job for months/years.

-To get an Entrepreneur/business visa you need substantial capital probably over US$100,000 and be able to open an actual business with employees etc, not a one man show from home.

If you don't have close family living here who are citizens, (even if you do the wait could be months or years) I would suggest falling in love with an American woman and marrying her to be your only option. Notice I said "falling in love" not commit "marriage fraud" as if you marry just for the green card you will have to live with her for at least two years, have joint accounts etc and will most likely be caught if it isn't genuine resulting again in you being arrested/deported and her being arrested.

But I am not an immigration attorney. Go for a free consultation and she/he will tell you basically the same thing if they are honest.

If they are not honest they will maybe offer to help you try to get a temporary employment visa eventually with many strings attached after you pay them thousands of dollars.

You might want to check, but a few years back a family friend moved here from Canada and he transferred his consulting business here. Because he was transferring a business they gave him citizenship.

work visas have yearly caps, i think the caps for 2006 are already exausted

and btw you can get a H1B (work visa) pretty easy IF you have an employer willing to go through all the hoops.


and no you can't legally buy a green card, that's bullshit.

If you have $1,000,000 and are willing to invest them in a business here in the US, then you get permanent residency. But there are catches, can't just drop the money and go

Thanks for your input :thumbsup . As for the moment i've got :

1 - Leave my GF, marry an american girl and stay 2 years with her
2 - Buy a fake green card and get deported
3 - Spend $1.000.000 in a US company
4 - Getting killed crossing the desert as a Mexican

Other possibilities ?

The U.S. is still the best place to live in my opinion. Strongest world econonmy by far, lowest inflation, low taxes compared to other western countries, highest employment, etc. At the lower rung of the ladder its a bitch (no free health care) but for upper middle class and topward its great.

I have many foreign friends that would like to move here, but, as pointed out, its almost imposible unless you are starting a significant business with employees.

I have one friend who managed it but it was a nightmare - 10 years in court before he finally got a green card. It helps if your country is ruled by a maniac, my buddy claimed asylum. :thumbsup

Otherwise the traditional way is to come over on a toursit visa and then marry an american girl; instant residency application and will be approved as longs as its not a sham.
