Brandon, she's hot alright... but if the end users get ahold of all of her content, without any real way to signup (unless they are truly bright enough to try the address in the address bar) then it is a waste of a hotty!

First off, I have both Win and Linux boxes, each for different needs, just like many people in the "real world". Plus, FreeBSD sucks.

Sultan: It's a two way street - you should always lock your car doors, but people who steal a car because it is unlocked are STILL THIEVES! Right now, Fusker is hotlinking and stealing from hundreds (if not thousands) of people, using their business resources and returning them nothing but a bandwidth bill.

Content used without copyright? Check!
no 2257 documentation? Check!
Possibly linking to CP? Check!
Stealing bandwidth from others? CHECK!

It's a great business model.

If someone is stealing your garbage cans everyday because there is no lock on them, should you have to weld them to the ground to protect them , or just arrest the idiot stealing them.

Bandwidth used without permission (at someone else's cost)
content used without a license.
content used without 2257 documents (who knows how old the models they link to are?)
content presented without context

They are far beyond "fair use"... they are not presenting a thumb that links to a page, they are presenting all of the images with the HTML stripped off - just pictures, nothing else.

This isn't like a newsgroup scooper (which is still legally VERY questionable), but outright theft. Theft of services (bandwidth) and theft of or misuse of copyrighted material (images) for commercial purposes.

it's not hard to figure out. I think I could even lead Judge Ware to water on this one.

Alex look man all I am trying to point out is that if its so illegal, where are the legal cases involving this practice? Hotlinking is RAMPANT we all know it, why oh why has there not been a definitive law related to this practice so we can do something other than complain and whine? Dont you think a few high profile legal suits would erode the benefits for people to hotlink?

Cambaby: Actually, go look up the fair use cases for images. You will see that what fusker does is far beyond fair use.

Further, they present the content within their site, on their web pages, with their advertising, without a license.

Content providers these days are pretty much lame-ass when it comes to legal action. They aren't making enough of a margin making content to be able to afford a lawyer to serve these people in another state, and they don't want to be the ones setting the precident. So the whole thing just goes on.

Programs (such as AVNAds) are not bound by court decisions to make their choices. It is clear within our community that this type of arrangement isn't good, it steals from other webmasters, and money is made by having other people pay to support your site unwittingly.

Any number of news organizations have already won lawsuits stopping "inside" linking of their material. Fusker is the ultimate inside linker.

cambaby, a single image, by itself, can be construed as "fair use"... it is also clear that the intention of this chat board isn't to share huge amounts of content. They are presented as part and parcel of discussions. That being said, in very technical terms, they too are stealing from someone else.

Fusker works by listing every single image from your site on a SINGLE webpage. It drives your server into the ground (imagine a gallery page with 30 pics @ 100k each... each visitor to the page on their site loads those 30 images at the same time (not the thumbs, the full size pics). Get 100 requests a minute (and fusker can generate that sort of traffic) and you are looking at 3000 * 100k bandwidth per minute - enough to bring many servers to their knees.

Those images are presented out of context, no gallery wrapper, no way for the site owner to make money. All the site owner does is pay for a server and bandwidth so this roach can make money.

Single images linked in the course of a chat board is a very grey area - and I have seen chat boards that allow users to post 100+ image links in a single post. It all comes down intent, when you think about it.
