A New Defense for Community Standards
I think it would be very interesting if EAs defense attorney subpoenaed raw shipping / subscription data (EXCLUDING personal data) from I-Bill, CC Bill, Paycom, Adam and Eve, Jaded Video, Adult DVD Empire, etc. to demonstrate just how many consumers of hardcore adult content are in a given community.
Even though I believe community standards is a flawed measure (too arbitrary and irrelevant given broadband delivery) I believe the numbers would not support the governments case and demonstrate a pattern of consumption forcing the government to the weaker argument that they have to protect the citizenship from itself (legislating morality). Even conservative judges aren't real comfortable going with that argument alone. It would be very interesting if someone at any of these organizations could comment on the statistics, particularly for the state of Pennsylvania where the government has taken action. Peace out...
