I wouldn't be too concerned, if you are, just don't hyperlink it. I recall a lawsuit against 2600 to remove links to DeCSS back in 1999 or 2000. The judge ruled that they couldn't hyperlink to the program but they could have text links.

maybe they can do something with htaccess. Stop you from linking is out of their control. I suppose they could attempt to make a legal issue of it, but don't think it would get anywhere? Not an attorney so just a lay opinion. Their attention to you would bring attention from the government, so you'd have to be squeakie clean...

The right thing to do is pull the links.

Legally, I don't think they can stop you. Drudge links to sites all the time that would prefer he didn't I suspect. He can swamp a server for sure. Since I'm not an attorney versed in that area of the law, MY opinion doesn't mean much. You could prolly get two answers from two different attoneys too.

You have no control who links to your site directly. I don't know what context you are linking to them in? If you are reporting a point of view or information they have, I believe that is all free speach as long as you site them or link to their index page etc.. If you are hot linking and using their art without permission, that is another issue. I think the context of your usage is paramont to the question.

If you are serious about getting the right answer, this is the wrong place. Hire an attorney review exactly what you are doing and get a written opinion from him or her. That way you have someone to sue when you get sued.

If that site is a church site, I would stay the hell away from it. If you are running a mainstream site, then give it a try.

You need to provide more info. Why do you have a link to their site? What is the purpose? Are you linking to them FROM a porn site? Are you linking to their site just to piss them off? What do you hope to gain by ignoring their request to take the link down?

I can't see how this can make you any money and they could put a real hurting on you if they wanted to (e.g., pressure a local DA to file obscenity charges against you). Adult webmasters have enough battles to fight with the extreme right. It's not in our best interest to 'create' new ones.

You do not need permission to post a link to someone elses site, as long as you make sure the link is understood to NOT be part of your site. A link is just a pointer to an HTML page, you can point wherever you want.

Anyways, after reviewing some court cases and laws I am going to say that it is almost definately legal. As long as you arent linking to a file, or image that they have copyrights or patents to. Also, you have to link to a "surface" page. IE: You have to link to the main page, not a page that is rooted in the site, for example, churchofmorons.com/afolder/anotherfolder/blah/thisisapage.html.

Apparently many court cases have dismissed the charges as unconstitutional under the first ammendment. And I asked a few lawyer friends, they all say that you can link to any page you want as long as you follow those guidelines I listed above. Adding a disclaimer denying affiliation with the site in question couldnt hurt either.
